1119 - Resolution - Rezone of Property4 s ; ,tTHE CITY OF PORT ORCHARD RESOLUTION NO. 1119 A resolution declaring that the rezone of 22 acres of property, a more particular description of which is attached and marked Exhibit A, from Residential/Convenience Center to Commercial General is in conformity with the Comprehensive Zoning and Land Use Plan for the City of Port Orchard which was prepared by Leo A. Daly Associates and adopted on May 22, 1972, Ordinance No. 895 of the City of Port Orchard; and declaring that the proposed use of the property, to wit: a Neighborhood Shopping Center, will have no significant effect on the quality of the environment. WHEREAS, the City of Port Orchard Planning Commission, during a public hearing held at 7:30 P.M. on February 20, 1973, recommended rezone of Laces of property classified as Residential/ Convenience Center tocial Genera and WHEREAS., after much research and study, the Planning Commission resolved that no significant effect on the environment was in evidence and WHEREAS, the City Engineer for the City of Port Orchard has made a study of the proposed use of the property and has determined that no significant effect on the environment was in evidence and WHEREAS, this rezone is in conformity with the Comprehensive Zoning and Land Use Plan for the City of Port Orchard which takes into consideration minor and major impact on all aspects of the environment; and WHEREAS, the City Council of the City of Port Orchard on February 26, 1973, reviewed the recommendation of the Planning Commission and approved the rezone application taking into consideration all aspects of the potential impact on both the short and long range to the environment and finding the proposed use of the property to be safe, healthful, pro- ductive and esthetically and culturally pleasing surroundings with beneficial uses of the environment without degradation, risk to health 11 or safety, or other undesirable and unintended consequences; and WHEREAS, the City Council resolved that the proposed use would constitute no significant effect on the environment; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Port Orchard, Washington 1) That the rezone application be approved; 2) That the rezone and proposed use are in conformity with the City of Port Orchards Comprehensive zoning and Land Use Plan; 3) That this resolution is to be considered as a negative declaration to be recorded as such under the requirements of the State Environmental Policy Act of 1971; Revised Code of Washington, Chapter 43.21C. 4) That the proposed use of the property has no significant effect on the environment.
