RESOLUTION NO. 1097
A RESOLUTION OF the City Council of the City of
Port Orchard, Washington, declaring its intention
to create a Local Improvement District for the
improvement of a portion of Bay Street and the
streets within and abutting the property described
herein extending northwesterly from Bay Street,
by the installation of covered walkways, lighting,
and ornamental shrubbery and decoration, declaring
the estimated cost thereof to be an amount of
One Hundred Fifty Thousand ($150,000.00) Dollars,
pre roviding that the costs shall be paid by assess-
ments against the property owners according to
the lineal frontage on Bay Street, and notifying
all persons who may desire to object to said im-
provement to appear and present their objections at
a meeting of the City Council to be held on'May 11,
1970.
WHEREAS, a Petition has been filed with the City Council of the
City of Port Orchard for the formation of a Local Improvement District
for the improvement of Bay Street within the area hereinafter described,
and the streets.within and abutting the hereinafter described property
extending northwesterly from Bay Street, by the installation of
covered walkways, lighting and ornamental shrubbery and decoration,
according to preliminary plans drawn by Gilman & Green, Architects,
and it appears that said Petition has been signed by the owners of
property aggregating a majority (1) of the lineal frontage upon the
improvement, and (2) of the area within the proposed District,'but
that said Petition states that the estimated cost of the improvements
is a cost of $120,000.00; and
WHEREAS, the City Council of .the City of Port Orchard deems
it advisable to henceforth proceed, using said Petition as the desire
of the property owners to install said improvements, following'ithe
resolution method for formation. of a Wocal Improvement District for
the reason that the estimated cost now appears to be an amount of
$150,000.00, and that it is advisable that the property owners.

the estimated costs and the estimated benefits of each property

owner's particular lot, tract or parcel, and of a time and pl

district; now, therefore,
THE CITY COliNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. It is the intention of the City Council of
City
of Port Orchard, Washington, to order the formation of a locallim-
provement district for the improvement of Bay Street within t
area hereinafter described, and for the improvement of the streets
within the property hereinafter described extending northwesterly
from Bay Street, by the installation of covered walkways, lighting,

and ornamental shrubbery and decoration, all according to plans and

specifications drawn and to be drawn by Gilman & Green, Architects.
The boundaries of such proposed local improvement district a
follows:
Commencing at the'Southwest corner of Lot 3, Block 12, S.M.
Stevens Town Plat of Sidney, as per plat recorded in volume 1 of
plats on page 1, records of Kitsap County, Washington; thence
southwesterly to the northernmost corner of Lot 7, Block 9, in
said plat; thence southwesterly along the westerly boundary of
said Lot 7, Block 9, to its intersection with Prospect Street; thenc
easterly along the northerly margin of Prospect Street to its in-
tersection with the westerly margin of Sidney Street; thence east-
erly to the Southwest corner of Lot 2, Block 12, First Addition to
Sidney; thence easterly along the southerly boundaries of Lot 2,
and Lot 3, Block 12, First Addition to Sidney, to the westerly
boundary of Lot 4, Block 12 in said plat; thence southerly along
the westerly boundary of said Lot 4, Block 12, to its southwest
corner; thence easterly along the southerly boundaries of Lot 4,
and 5, Block 12 in said plat to the southeast corner of said Lot 5,
Block 12; thence North along the easterly boundary of said Lot 5,
Block 12 to the Northeast corner thereof; thence across Bay Street;
to the Southeast corner of Lot 12, Block 13, First Addition to
Sidney; thence along the easterly boundary of Lot 12, Block 13,
First Addition to Sidney, and tidelands abutting 230 feet more or
less to a point east of the north end of sidewalk on east margin
of Sidney Avenue; thence West to end of said sidewalk, 130 feet
more or less North of the Southwest corner of said Block 13;
thence Northerly along the easterly margin of Sidney Avenue to
the Inner Harbor Line; thence Westerly along the Inner Harbor
Line to the Northwest corner of tidelands fronting Lot 3, Block 12
S. M. Stevens Town Plat of Sidney; thence Southerly along the
westerly boundary of said tideland lot and Lot 3, Block 12 to the
point of beginning, Kitsap County, Washington, as outlined on
attached diagram.

Section 2. The estimated cost of the said improvements is

an amount of $150,000.00. It is the intention of the City Council
that the cost of said improvements shall be borne by and assessed
against the property especially benefited by such improvement to be
included in the local improvement district to be established embrac-
ing as near as may be all property especially benefited by such im-
provement and with the proposed boundaries as above set forth.' The
assessment shall be computed according to.the estimated benefits of
each particular lot, tract or parcel, according to the lineal frontage
of each lot, tract or parcel along Bay Street.
Section 3. All persons who may desire to object to the improve-
ment herein mentioned are hereby notified to appear and present
such objections at &,meeting of the City Council .to be held in!the
Council Chambers in the City :Mall, Port Orchard, Washington, at
7:30 o'clock P.M. on May 11, 1970, which time and place are hereby
fixed for hearing all n�,atters relati'rg to said proposed improvement
and all objections thereto and for determining the method of payment
for said improvement.
Section 4. Gilman & Green, Architects, and Roats Engineering
are hereby directed to submit to the City Council on or prior to the
llth day of May, 1970, all data and information.required by law to be

The foregoing Resolution was adopted by the City Council of the
City of Port Orchard, Washington, and approved by the Mayor ata
regular meeting thereof on this 13th day of April, 1970.
