RESOLUTION REQUESTING VGY
OF MAPLE
STREET 'WWATER
*IEREAS, the Council of the Town of Port Orchard was petitioned
for a Resolution requesting the Commissioner of Public Lands to vacate
the Maple Street Waterway, as platted in Sidney (now Port Orchard) tide-
lands, in front of Annapolis Addition, as shown on the official maps of
the said tidelands on file in the office of the Commissioner of Public
Lands at Olympia, Washington; and
WHEREAS, the Council of the Town of Port Orchard held three
hea3ings on the question as to whether or not it would be in the public
interests to vacate the said waterway, and after the said hearings deter-
mined that the Maple Street Waterway has not been excavated nor is pres-
ently in use for purposes of navigation and is no longer required in the
public interests as a waterway, but that Black Jack Creek flows across
Lots X and Y, Sidney (now Port Orchard), Tidelands in front of Annapolis
Addition, Kitsap County, Washington;
NOW, THEREFORE, be it and it hereby is resolved by the Council
of the Town of Port Orchard
Section 1: That Maple Street Waterway as platted in the plat
of Sidney Tidelands in front of Annapolis Addition, Port Orchard, Kitsap
County, Washington, has not been excavated and is not in use for the pur-
poses of navigation and is no longer required in the public interests as
a waterway.
Section 2: That the Commissioner of Public Lands of the State
of Washington is hereby requested to vacate all of the said Maple Street
Waterway upon condition that the owners of Lots X and Y, Sidney Tidelands
execute good and sufficient conveyances to the State of Washington of
a sufficient portion of the said lots X and Y to permit Black Jack Creek
ample flowage over the said lots X and Y.
PASSED by the majority of the Council of the Town of Port
Orchard in regular session and signed by the mayor attested by the
Town Clerk this 28th day of May, 1956.
