A RESOLUTION AUTHORIZING THE TOWN TREASURER TO ACCEPT A
DEED TO PROPERTY AND CANCEL AN ASSESSMENT LEVIED UNDER LOCAL
IMPROVEMENT DISTRICT NO. 39 IN LIEU OF FORECLOSURE.
BE IT RESOLVED BY THE COUNCIL OF THE TOWN OF PORT ORCHARD:
1. That heretofore by Ordinances No. 429 and 448 Local
Improvement Histrict.No. 39 was created for the construction of
concrete sidewalks on High, Division and Hull Streets and that
the cost thereof was assessed against the property lying within
the boundary lines of said improvement district in the manner
and form prescribed by law.
2. That all assessments levied under said Local Improve-
ment District No. 39 have been fully paid except the assessment
levied against Lots 7 and 8 in Block 1, Re -plat of Central
Addition to Sidney, except street, and that the total of in-
terest and penalty against said lots is now over $100.00 and
that these fractional lots are not worth the cost and expense
of foreclosing the delinquent assessments against same.
3. That all indebtedness against said Local Improvement
District No. 39 has been fully paid and there are no outstand-
ing bonds against same.
4. That John H. Kelly and Velma F. Kelly, husband and
wife, the legal owners to said property.have tendered a quit Claim
deed conveying to the Town of Port Orchard, a municipal corpora-
tion, the fee in and to said fractional lots.
5. Now, therefore, in consideration of the premises,
Chloe Sutton, the Town Treasurer, be, and she hereby is, author-
ized and directed to accept said deed for and in behalf of the
Town of Port Orchard and cancel from her records the assessment
lien against Lots 7 and 8, Block 1, Re -plat of Central Addition
to Sidney, except street, in lieu of foreclosure.
PASSED by the Town Council of Port Orchard this 14th day
of June, 1948.
