RESOLUTION
j BE IT RESOLVED BY THE TOWN
1 COUNCIL OF THE TOWN OF PORT
ORCHARD:
SECTION 1. That it is the intention
of the Town Council of the Town of
e Port Orchard, to improve ' Rockwell
Avenue in said Town by cutting, fiil-
ing and grading said portion of said.
avenue to an establi.hed grade of 16
(feet wide and by constructing con-
crete gutters, and paving the same
with concrete to a width of 14 feet,
and a depth of 6 inches at the top of
the Avenue and seven inches at the
bottorn, from the South margin of
East Day Street to tht North margin
of Kitsap Street, and - grading ap-
proaches to streets and alley, run
'I nmg into Rochwell Avenue, all in ac
!'cordance with the plans aim gpecifi--
cations to be prepared therefor and
!filed with the,.Clerk of the Town.
.SECT10N 2. That to pay the cost
of said imilrovenient `it is prupo*e(L
to create an assessment district of
all the lots or i parcels of land specui-
cally benefitted thereby lying between
the mouth 'ide of ' Say street and the
'North side of Kitsap Street abutting
upon, adjacent, vicinai or proximate,
to said street to be improved from
the marginal ➢fines thereof to ,the
center of the blocks facing or abutting
`thereon, and at least ninety feet there -
`from and to assess the cost and ex-
pense of the imps uvement upon all
of ,the said property ,co benefitted
and according to the special benefits
conferred upon such property in pro-
portion to the area and distance from
marginal lines thereof to the center
of the blocks facing or abutting there-
on as .provided by the laws of the
State of Washington.
SECTION 3: That it Is proposed to
make the assessment for said im-
provement to be levied as aforesaid,
i payable in three annual installments,
with interest at 'i per cent per an,
num, and to issue warrants or bonds
therefor payable out of said district,
the first instalment to be payable
Within 30 days after notice of the
Treas. he has received the assessment
ro!l for coile,tion, and the second in-
stalment within one year from the
date of said hotice„ and the third in-

I SECTION 4. That all persons who
-.!may desire to object to the said pro-
posed improvement are hereby notifi-
ed to appear and present such ob-
1; jections at the . regular meeting of
ihe Town Council to he held on the 1
th day of May 1924 at 7:30 p.m, of I
said day, which is hereby fined for
the tirn•a and place of hearing such i
objections.
SECTION 5. That an engineer be'
l employed for the making of said im-
'proven,cnt and that he is hereby di-
rected to submit to the Town Coun-
cil at or pri-,)r to the date fixed for
the hearing of any objections to the
(said proposed improvement a state-
mrut showing the cost and expense
lof such improvement. the proportion-
I ate amount to be borne by the pro-
perty within the said proposed assess-
I ment di..qtrilot, the' -value of the real
estate, exclusive of improvements,
within the. district according to the
valuation placed upon the same for
purposes of g-peral taxation, to-
gether with a diagram or print show-
ing thereon said lotq, tracts or tracts
of land specially benefitted and the
estimated cost and expense to be[
I borne by each of said_ Iots, tracts or
parcels of land.
