Summary: RCW 35A.40.210 and 35.23.352(7) requires each city to designate an Official City Newspaper, which shall be a paper of general circulation within the city, published (in hardcopy)
at least once a week. In June 2022, the City issued a Request for Newspaper Public Services and received two bids: (1) from Kitsap Sun; and (2) from the Port Orchard Independent. The
Port Orchard Independent was the lower, responsive bid, and on July 12, 2022, the Council adopted Resolution No. 070-22, authorizing the Mayor to execute a one-year contract for these
services to the Port Orchard Independent. In late October 2022, the City was notified that the Port Orchard Independent was not publishing the week of November 11, 2022. By this action,
the Port Orchard Independent will not meet the weekly publication requirement and substantially impact the City’s ability to timely notice legislation and hearings, including time sensitive
hearings on the City’s biennial budget.
Staff recommends terminating the agreement with the Port Orchard Independent and entering into a contract with the Kitsap Sun for Official City Newspaper services. The Kitsap Sun has
stated it will honor the rates identified in its bid submitted to the City in June 2022. Staff have confirmed that meet the statutory qualifications for the City’s Official City Newspaper
insofar as there are no other newspapers printing at least weekly in hardcopy that have general circulation within the city. This request is time-sensitive to meet the City’s needs
for publication.
Recommendation: Staff recommends the City Council repeal Resolution No. 070-22, and authorize the Mayor to execute a one-year contract with the Kitsap Sun for publication services as
the Official Newspaper of the City.

Motion for consideration: “I move to adopt a Resolution declaring Kitsap Sun as the City’s Official Newspaper, and repealing Resolution No. 070-22.”
Fiscal Impact: This service is included in the budget.
