087-22 - Port Orchard Police Guild-Sergeants - Supplement / Change Order MOU 3Memorandum of Understanding Amended to the AGREEMENT by and between CITY OF PORT ORCHARD, WASHINGTON and PORT ORCHARD POLICE GUILD (Representing Sergeant Employees) dated January 1, 2022 through December 31, 2024 THIS AMENDMENT is supplemental to the AGREEMENT by and between the CITY OF PORT ORCHARD, WASHINGTON (the "City") and the PORT ORCHARD POLICE GUILD (the "Guild") (representing Sergeant Employees), dated January 1, 2022 through December 31, 2024. WHEREAS, the Agreement between the City and the Guild was signed by both parties on June 15, 2022; and WHEREAS, the process for accrual of vacation leave was changed as a result of the implementation of this Agreement; and WHEREAS, the conversion of the former vacation leave accrual system into the new vacation leave accrual system resulted in some employees having large vacation leave balances; and WHEREAS, the number of vacancies in the Police Department has resulted in some staff having difficulty arranging vacation time off; and WHEREAS, both parties have an interest in removing language in the Agreement related to taking 5 consecutive days of leave; and WHEREAS, both parties have agreed that it is in the best interest of both the City and the Guild to allow employees some additional time to use their paid vacation leave on a one-time non- precedential basis; and WHEREAS, allowing employees to rollover a larger than usual amount of vacation into 2023 should allow those employees to adequately plan and take enough paid vacation time by the end of 2023 to return to the previously determined carryover limit; NOW THEREFORE, the City and the Guild agree as follows: 1. On a one-time, non -precedent setting basis, employees may carry over a maximum of three hundred and eighty (380) hours of accrued vacation from December 31, 2022 to January 1, 2023. 2. This MOU does not alter the limits on payment of accrued vacation upon separation of employment. 3. The parties agree to amend the Agreement by removing Article 11.2 on the effective date of this MOU. Article 11.2 states: "Each employee must use at least one week (five (5) consecutive days) leave each year for a vacation purpose." The remainder of Article 11 will be renumbered when the Agreement reopens for negotiations. 4. This MOU is effective when signed by both parties. This MOU does not establish a past practice and may not be used or cited by either party as precedent in any future dispute between the parties.
