Summary: The City of Port Orchard appointed Sound Law Center as its Hearing Examiner, pursuant to Port Orchard Municipal Code Chapter 2.67, to provide examiner services for code enforcement
and land use / permit decisions. The volume of work requires a second Hearing Examiner to meet current demand. The City has identified Phil Olbrechts of Olbrechts & Associates, PLLC,
as a qualified professional Hearing Examiner to provide these services, and obtained a proposal from Mr. Olbrechts for these services. Appointment of the hearing examiners for the City
requires Council action.
Mr. Olbrechts has conducted over 1,500 land use hearings as a hearing examiner since the 1990s, and serves as Hearing Examiner for twenty-two municipalities, as alternate Hearing Examiner
for five municipalities, and City Attorney for two others. Mr. Olbrechts provided a proposal (attached hereto) for Hearing Examiner services billed at $190/hr. plus associated costs.
Staff would monitor costs associated with this Agreement and the total not to exceed would be $140,000.
Recommendation: Staff recommends confirmation of Mr. Olbrechts of Olbrechts & Associates, PLLC, as a Hearing Examiner for the City.
Relationship to Comprehensive Plan: Chapter 2, Land Use; Chapter 3, Housing.
Motion for consideration: “I move to adopt a Resolution confirming the appointment of Phil Olbrechts of Olbrechts & Associates, PLLC, as a Hearing Examiner for the City, and authorize
the Mayor to sign an agreement for these services.”
Fiscal Impact: Costs are within budget for this service.
Alternatives: Not approve and provide alternative guidance.
