MEMORANDUM OF UNDERSTANDING
BETWEEN
THE CITY OF PORT ORCHARD
AND THE TEAMSTERS LOCAL NO. 589
(REPRESENTING THE POLICE SUPPORT STAFF)
The City of Port Orchard ("City") and Teamsters No. 589 Representing the Police Support
Staff (Union) enter into this Memorandum of Understanding ("MOU") regarding work during
inclement weather or a state of emergency.
WHEREAS, the COVID-19 pandemic made more options available to employees to
effectively and efficiently work remotely;
WHEREAS, logistical and privacy concerns of the information accessed and maintained
by the Police Department has led to delays in authorizing remote work for Police Department
personnel;
WHEREAS, technological solutions and oversight are now available to enable remote
work of Police Department personnel; and
WHEREAS, from time to time, such remote work is advantageous to the City; and
WHEREAS, the Union and the City desire to make remote work an option to members of
the Union in certain circumstances;
NOW, THEREFORE, the City and the Union agree as follows:
1. On the effective date of this MOU, Article 8.7 of the collective bargaining agreement
("CBA") between the City and the Union representing Police Support Staff shall be
modified as follows:
8.7 CITY HALL CLOSURE DUE TO INCLEMENT WEATHER OR STATE OF
EMERGENCY.
(1) City Hall is Closed to the Public and Closed to Employees.
If at any time, the Mayor or designee closes City Hall to the public and to employees
due to inclement weather or a state of emergency, the Chief of Police or designee will
determine which employees are needed in order to accomplish the business needs of
the City. The City will pay employees who are not needed at work for the equivalent
time of their regular working hours for that day and they will not be required to use
leave. Employees who are already at City Hall and are required to stay or asked to
report to work on site by the Chief or designee shall be
paid double time for the hours worked. Employees
who are assigned to work remotely by the Chief or designee shall be paid their straight
time rate for hours worked. The foregoing shall net apply te situatietis in whie

Health Navigator will contact the Chief or designee as to what hours they will need to
work.
(2) City Hall is Closed to the Public But Rcmains_O - n for Employees to Work.
The Mayor or designee may close City [fall to the public due to inclement weather or
a state of emergency but keep City Hall open for employees to work. In such situations,
at the discretion of the Chief of Police, or designee, non -probationary employecs may
be permitted to work remotely to meet the needs of the department. When, at the Chief,
or desiz7nee's discretion, staff is required on site, staff members may be given the
opportunity to volunteer to be assigned to work at City Hall. If no_employee volunteers
or additional employecs are needed, employees required to report to or remain at work
will 7e� ncrally be assigned to work in inverse order of seniority on a rotational basis.
The frequency of rotation will be per day unless otherwise agreed upon. Hours worked
will be paid at straight time. Employees not working remotely and not -reporting _to_or
remaining at the office will take available paid leave for the unworked hours.
Probationary employees znay be permitted to telecommute on n a case -by -case basis at
the discretion of the Chief, or desi€>,nec. All authorized remote work will be in
accordance with the City's established policies related to telecommutiitig`
2. This MOU is effective when signed by both parties. No modification to this MOU is
valid unless in writing and signed by the parties.
