01/28/2019 - Minutes 1 City of Port Orchard Land Use Committee Meeting Minutes – January 28, 2019 Committee Members Present: Scott Diener (chair), Fred Chang, Jay Rosapepe City Officials and Staff: Mayor Rob Putaansuu, Community Development Director Nick Bond, Public Works Director Mark Dorsey, Assistant City Engineer Mike Pleasants, Long Range Planner Keri Sallee Guest: Dick Brown Chair Diener called the meeting to order at 9:35 am. 1. Discussion: Yamamoto UGA Request. Mr. Dick Brown, representing the property owner, submitted a request for the City’s support in adding three parcels known as the Yamamoto properties to the City’s urban growth area (UGA). The parcels are located on the east side of Sidney Rd SW, south of Albertsons at the corner of Sidney and Sedgwick. The addition would also require bringing in two other properties located directly adjacent to the Albertsons property. Brown stated that in order for Kitsap County to support the UGA expansion, the County would need to receive strong support from the City. Mayor Putaansuu said that the City’s 2019 deadline for comprehensive plan amendment applications (including UGA expansion requests) is January 31, 2019, and there would be no opportunity for City Council to review and comment on the proposal prior to the application deadline. Council Member Cucciardi expressed concern that if the City added land to its UGA in one location, the existing size and buildable lands capacity of the UGA might force the City to reduce its UGA in other areas. Community Development Director Bond said that a UGA expansion proposal would need to include an evaluation of the City’s capacity to provide urban services to an expanded UGA, per the Countywide Planning Policies. These services include water, sewer, stormwater, transportation, schools, and emergency services. The City would also have to demonstrate why its existing population allocation and need for commercial land could not be accommodated within the existing UGA using reasonable measures such as upzoning. Chair Diener said that it would be preferable to have a subarea plan already completed for the Sidney/Sedgwick local center prior to any UGA expansion in this area, so that it could be determined how an expansion would fit into the plan. Putaansuu said that the Council may be willing to put these properties on the “short list” for potential UGA expansion after the City’s buildable lands and associated growth needs are reviewed by the City and County in 2022. 2. Discussion: 2019 Engineering Standards and Specifications. Assistant City Engineer Mike Pleasants gave an overview of the draft Public Works Engineering Standards and Specifications (PWESS) document that has just been completed. It should be adopted and used in conjunction with the updated Zoning Code that is proposed for Council approval in February, in order to provide developers with complete development guidance and technical specifications. Public Works Director Dorsey said that the draft PWESS has been reviewed by the Kitsap Building Association and local developers. The committee agreed that the PWESS should be provided to the Council for review at the February work-study meeting. 3. Discussion: Street Cut Moratorium. Dorsey presented a draft ordinance that would prohibit cutting or excavating City-owned pavement for 5 years after the resurfacing or construction of such pavement, except in limited circumstances. When cutting or excavation is allowed, the pavement must be restored according to the City’s adopted pavement restoration standards. This requirement will also be included in the PWESS. The purpose of the moratorium is to prevent continual pavement removal and degradation caused by utility contractors. The committee agreed to move this item forward to the February work-study meeting. 2 4. Discussion: Zoning Code Update. Bond said that the draft Zoning Code and Zoning Map update has been completed, and the Planning Commission will hold a public hearing on the code and map and make a recommendation to Council at its February 5 meeting. The draft documents have been provided to the public for review, and property owners whose property zoning would be significantly altered have been notified of the proposed changes. Bond reviewed several issues which are most significant and could be of public interest, including: changes to the downtown overlay district and the view protection overlay district; requirements for residential setbacks and subdivision connectivity; a permanent self-storage overlay district; a requirement for need analysis for new self-storage facilities and gas stations; the addition of mixed-use zones for both residential and commercial uses; a new program for transfer of development rights from unincorporated Kitsap County; requirements for offstreet parking and parking reduction; bicycle and electric vehicle parking standards; and a new significant tree retention code. Diener asked that the Planning Commission consider whether new self- storage facilities should be required to be multi-story, to conserve commercial land.
