06/21/2017 - Minutes City of Port Orchard Land Use Committee Meeting Minutes – June 21, 2017 Committee Members Present: Scott Diener (Chair), John Clauson, Shawn Cucciardi City Officials and Staff: Mayor Rob Putaansuu, Community Development Director Nick Bond, Public Works Director Mark Dorsey, Associate Planner Keri Sallee Guests: Norm Olson (N.L. Olson & Assoc.), Dan Wolfard (RV Assoc. Inc.), Bjorn Bjorke (McCormick Woods Golf Course), Ken Kambich (Shiers Law Firm). Chair Diener called the meeting to order at 7:30 a.m. 1. Discussion: Gravel Mine Expansion at Port Orchard Industrial Park. RV Associates, Inc., has inquired to see whether the City would be interested in allowing their gravel mine expansion onto property currently owned by the city within the Port Orchard Industrial Park, in order to conduct an approximately 10-year mining operation. The Committee discussed the proposed scope of mining operations, and whether a subdivision, boundary line adjustment, development agreement and/or land lease would be required. RV has indicated that they would be willing to construct public road and utilities to provide access to other City-owned land and would grade the City- owned property to create industrial building pads as part of an agreement with the City. The road improvements would also facilitate access to adjacent privately-owned properties that currently do not have commercial/industrial access. The Committee agreed to forward the item to Council for discussion at the July work-study meeting to determine the City’s level of interest in RV’s proposal. The Committee asked staff to research what approvals would be needed and what alternatives exist for developing an agreement between the City and RV. After conclusion of this discussion, Council Member Cucciardi recused himself from discussion of the next item (Golf Cart Zone in McCormick Woods) to prevent a potential conflict of interest. 2. Discussion: Golf Cart Zone in McCormick Woods. The Committee reviewed a request by McCormick Woods Golf Course to establish a “golf cart zone” in McCormick Woods, within which golf carts could be legally operated on public roads. A draft ordinance prepared by the Golf Course’s attorney was also provided. The Committee requested staff to obtain input from the Municipal Research Services Center, the Association of Washington Cities, and the City attorney, regarding potential liability concerns, recommended safety equipment, and other issues. The request will be forwarded to Council for discussion at the July work-study meeting. 3. Discussion: Vacant Commercial Buildings. The Committee discussed potential regulations, such as those in the land use codes of the cities of Everett and Vancouver, which provide specific requirements for the maintenance of vacant commercial buildings, and enforcement options for commercial buildings that are not maintained. Community Development Director Nick Bond will discuss this issue with the City’s code enforcement officer, Doug Price, and will report back to the Committee with recommendations.
