07/20/2016 - MinutesCity of Port Orchard Land Use Committee Meeting Minutes July 20, 2016 Committee Members Present: Bek Ashby (for John Clauson), Shawn Cucciardi, Scott Diener City Officials and Staff: Mayor Rob Putaansuu, Development Director Nick Bond, Public Works Director Mark Dorsey, Associate Planner Keri Sallee Chairman Diener called the meeting to order at 7:35 a.m. 1. Discussion: Regulation of Drone Operations. The committee discussed a citizen’s request for the City to consider regulating the operation of drones within neighborhoods. The committee determined that FAA rules significantly limit the City’s ability to regulate drones, other than certain activities that are already prohibited by law, such as voyeurism and harassment. Associate Planner Sallee was requested to contact the citizen and suggest that he contact the Police Department if he continues to have problems with drones in his neighborhood, and to forward the citizen’s request and FAA regulatory guidance to Police Chief Marti. 2. Discussion: Amendments to POMC Title 16 – Administrative Conditional Use Permits, etc. Development Director Bond presented a package of amendments to the City’s land use regulatory code (POMC Title 16), which will delete the administrative conditional use permit process, allow churches in all zones, update the requirements for home based businesses, and clarify the definition of an accessory dwelling unit. The amendment is scheduled for a public hearing before the Planning Commission on August 2, and the ordinance will be brought to the full Council for review on August 9. 3. Discussion: Shoreline Master Program – Amendment for Redevelopment Projects. Bond presented a package of amendments to the City’s Shoreline Master Program (SMP) intended to enhance the ability of waterfront property owners to redevelop and improve their properties. At present, the SMP requires a 75-ft buffer from the shoreline for properties within the “High Intensity” shoreline designation. The proposed changes will provide more options for property owners to redevelop within the same footprint as existing buildings, with mitigation requirements to improve existing shoreline conditions and ensure no net loss of shoreline habitat or water quality. Several additional “housekeeping” amendments are also proposed for consistency between the SMP and the Zoning Code, and to bring the SMP up to date with the adopted 2016 Comprehensive Plan. The amendment is scheduled for discussion at the Planning Commission’s August meeting, and a public hearing before the Planning Commission in September. 4. Discussion: Implementation of 2016 Comprehensive Plan. Since this issue was discussed at the July 19 Council meeting, Diener removed this item from the agenda. 5. Discussion: POMC 16.20.208 - Minimum Residential Unit Size in Downtown Overlay District. Mayor Putaansuu proposed to remove the 600 sq ft minimum size requirement for residential units in the Downtown Overlay District, as it is an unnecessary constraint on potential redevelopment of downtown properties. The committee agreed, and requested Bond to prepare an ordinance for this change. 6. Discussion: POMC 16.20.201 – Permitted Uses in Downtown Overlay District. The committee discussed potential changes to uses within the Downtown Overlay District. Bond noted that the Planning Department is working on an overall update to Title 16, but an interim amendment could address some of the committee’s proposed changes, as well as the removal of the minimum lot size as discussed in item 5. Planning staff will work on an interim amendment to be presented to the committee in September. 7. Discussion: Proposed New POMC 12.30 – Complete Streets. Bond and Public Works Director Dorsey presented a “Complete Streets” ordinance that will help the City qualify for grant funding for transportation improvements. “Complete Streets” refers to transportation projects that accommodate a complete spectrum of transportation users (e.g., bicyclists, pedestrians, transit riders and disabled persons) by providing facilities such as sidewalks, bicycle lanes, accessible curb ramps, crosswalks, etc., as well as automobile lanes. The proposed ordinance will be brought to the full Council for review on July 26. 8. Discussion: Proposed New POMC Chapter 12.24 – Street Use Permits. Bond presented draft code language for a City street use permit process, to allow activities such as sidewalk table dining, sidewalk sales displays, etc. The proposed ordinance will be brought to the full Council for a public hearing and review on July 26. Chairman Diener adjourned the meeting at 8:47 am. Next Meeting/Location: The August meeting was cancelled. The next meeting is scheduled for September 21 at 7:30 am, in the Council Chambers.
