Meeting Minutes
March 19, 2018
Utility Committee Members Cindy Lucarelli, Jay Rosapepe and Fred Chang met on
March 19, 2018 at 9:30 a.m. at the Port Orchard City Hall – Room #306. Also present:
Public Works Director/City Engineer Mark Dorsey and Water/Sewer Utility Manager
Thomas Hunter.
WSUD Draft Franchise Agreement - Update: PWD Dorsey advised Committee
members that efforts to obtain an executed Franchise Agreement with WSUD have
failed. The primary issue is WSUD’s continued refusal to comply with the City’s desire
to have ALL contractors and/or utility providers meet the requirements of a Right-of-
Way Permit (Traffic Control Plan and Bonding.) PWD Dorsey to send an email to
General Manager Wilson, advising WSUD that no RW Permits will be issued until the
Agreement is executed and work performed within the RW without a RW Permit will be
stopped. To be continued.
Foster Pilot Project Participation - Discussion: WSUM Hunter provided
Committee members with a brief overview of the Foster Pilot Project, whereby the
legislatively directed (Senate Bill #6091) – Department of Ecology managed Project;
1) Is an outcome of the Hirst decision.
2) Involves Municipal Water Law/Water Rights.
3) Involves historical water source withdrawal mitigation vs. future mitigations
options.
4) Includes Local, State and Tribal participation.
5) Can draw upon the recent 5-year long USGS Groundwater Study results.
6) Will ultimately assist in the City’s future need to convert the Well#12/#13
‘permitted’ source(s) to ‘perfected’ source(s).

Marina Pump Station CIP - Update: PWD Dorsey provided Committee members
with an update on this much needed Sanitary Sewer CIP. Having scored well enough to
be offered a 20-year $4.1M loan at 2% terms, the City has recently completed the
professional services procurement process for the Ad Ready Design and Permitting
phase of the project, selecting RH2 Engineering. The City is now working with RH2 on
developing the Project Scope and Budget. To be continued.
Well No. 9 - Update: PWD Dorsey and WSUM Hunter updated Committee members
on the Well No. 9 Water Treatment Retrofit Construction Project, being that due to an
‘omission’ within our Contract template, the Project was again re-advertised on March

16, 2018, with the new Bid Opening now scheduled for March 30, 2018. To be
