066-24 - Resolution - HVAC Service for 730 Prospect StreetDocusign Envelope ID: F6DF735E-DD6C-4286-A1 FO-71 F34E8F2CBF 11[91ll\L9KIII-T ► ,I A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, APPROVING A SMALL WORKS CONTRACT WITH HAWK'S HEATING AND AIR CONDITIONING, LLC, FOR THE 730 PROSPECT ST BUILDING HVAC REPAIRS PROJECT AND DOCUMENTING PROCUREMENT PROCEDURES. WHEREAS, on May 28, 2024, City Council approved the purchase of a building and property located at 730 Prospect Street; and WHEREAS, the City Public Works Department determined that the HVAC units that service the building need to be repaired/replaced, collectively named the 730 Prospect St Building HVAC Repairs Project (the "Project"); and WHEREAS, to identify a Contractor for the Project, staff utilized the small works procurement process authorized in State law and the City's Procurement Policies adopted by Resolution No. 073-23, as amended; and WHEREAS, the City is a member of the Municipal Research and Services Center of Washington (MRSC) Small Public Works Roster program, and MRSC solicited on behalf of participating local government agencies, including the City, within Washington State for the 2024 MRSC Small Public Works Roster; and WHEREAS, on September 26, 2024, pursuant to RCW 39.04.155 and the City's Procurement Policies, the City's Public Works Department established a list of qualified contractors from the MRSC 2024 Small Works Roster for the Main Category — HVAC and Sub - Category — General, a copy of which is attached hereto as Exhibit A and incorporated herein by this reference; and WHEREAS, on October 3, 2024, and pursuant to Resolution No. 073-23, the City's Public Works Department issued an email Invitation to Bid for the "Project" to two hundred forty-two (242) qualified contractors on the selected roster; and WHEREAS, by the 2:00 deadline on October 24, 2024, six (6) bids were received, and staff reviewed the bids and determined that Hawk's Heating and Air Conditioning, LLC submitted the apparent lowest qualified bid for the Project; and WHEREAS, the Public Works Department reviewed all materials and verified that the bidding requirements for this public work have been followed, and on November 4, 2024, the City's Public Works staff completed the MRSC Mandatory Bidder Responsibility Checklist; and WHEREAS, after reviewing the proposal and verifying the contractor's information, Public Works Staff and determined that Hawk's Heating and Air Conditioning, LLC bid of $56,487.40 (Applicable Tax Included) was the lowest, qualified, responsive and responsible bidder for the project; and Docusign Envelope ID: F6DF735E-DD6C-4286-A1 FO-71 F34E8F2CBF Resolution No. 066-24 Page 2 of 2 WHEREAS, the City's Procurement Policies require City Council authorization for purchasing budgeted items that cost $35,000 or more, and for unbudgeted purchases; and WHEREAS, the Port Orchard City Council, at the 2015 recommendation of the State Auditor's Office, wishes to document their selection/procurement process as described herein for this purchase by Resolution; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: It is the intent of the Port Orchard City Council that the recitals set forth above are hereby adopted and incorporated as findings in support of this Resolution. THAT: The City Council authorizes the Mayor to execute a contract, in a form acceptable to the City Attorney, with Hawk's Heating and Air Conditioning, LLC in an amount not to exceed $56,487.40 (applicable tax included). The Mayor or his designee is authorized to take all actions necessary to effectuate the purchase consistent with this authorization. THAT: The Resolution shall take full force and effect upon passage and signatures hereon.
