068-24 - Resolution - MOU's with Teamsters Regarding Bereavement LeaveDocusign Envelope ID: A6FE889D-CD1 C-45AF-964C-41 B61 FE6E3A0 RESOLUTION NO. 068-24 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, AUTHORIZING MEMORANDUMS OF UNDERSTANDING WITH TEAMSTERS LOCAL 589 REPRESENTING POLICE SUPPORT STAFF, PUBLIC WORKS EMPLOYEES AND MUNICIPAL COURT EMPLOYEES REGARDING BEREAVEMENT LEAVE. WHEREAS, the City continues to evaluate and, where appropriate, modify the City's personnel policies; and WHEREAS, through the authority granted by Resolution 007-11, the Mayor can modify existing personnel policies; and WHEREAS, in September 2024 the Mayor approved a change to the City's personnel policy regarding bereavement leave to include sons and daughters in law, aunts, uncles, nieces and nephews in the list of family members to which bereavement leave was applicable, changing all descriptors to gender neutral terms and removing a requirement for a paper authorization form; and WHEREAS, in the spirit of good labor relations, the expanded list of family members was proposed to the three bargaining groups represented by Teamsters Local 589; and WHEREAS, the three bargaining groups represented by Teamsters Local 589 have approved the proposed changes to their respective bereavement leave provisions of their collective bargaining agreements; now, therefore; THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: It is the intent of the Port Orchard City Council that the recitals set forth above are hereby adopted and incorporated as findings in support of this Resolution. THAT: The Mayor is authorized to sign the Memorandum of Understanding (MOU) with the Teamsters Local 589 representing Police Support Staff amending Article 14 of the 2022-2025 collective bargaining agreement with the City substantially in the form attached hereto as Exhibit 1. THAT: The Mayor is authorized to sign the Memorandum of Understanding (MOU) with the Teamsters Local 589 representing Public Works Employees amending Article 14 of the 2022-2025 collective bargaining agreement with the City substantially in the form attached hereto as Exhibit 2. THAT: The Mayor is authorized to sign the Memorandum of Understanding (MOU) with the Teamsters Local 589 representing Municipal Court Employees amending Article 14 of Docusign Envelope ID: A6FE889D-CD1 C-45AF-964C-41 B61 FE6E3A0 Resolution No. 068-24 Page 2 of 2 the 2022-2025 collective bargaining agreement with the City substantially in the form attached hereto as Exhibit 3. WHEREAS, the 2022-2025 collective bargaining agreement between the parties provides for bereavement leave; and WHEREAS, in the regular course of reviewing and updating City policies, it was found that the City policy related to bereavement did not include relatives such as the spouse of an employee's child, aunts, uncles, nieces and nephews; and WHEREAS, the City desires to be as inclusive as possible and use gender neutral terms in policy language where applicable; and WHEREAS, the City desired to eliminate the need for an employee requesting bereavement leave to complete a paper form; and WHEREAS, the City desires to provide the same bereavement leave benefits to employees represented by the Teamsters Local 589 as are currently available to non - represented employees; NOW THEREFORE, the City and the Union agree as follows: On the effective date of this MOU, Article 14 of the collective bargaining agreement ("CBA") between the City and the Union representing Police Support Staff shall be modified as follows: 14.1 Employees shall be allowed up to twenty-four (24) hours of paid bereavement leave for death in the immediate family upon approval and authorization of the Chief of Police or designee. The Chief of Police or designee may require verification of the family member's death. For travel out of She state an employee shall receive, subject to the approval of the Chief of Police or designee, an additional sixteen (16) hours of paid bereavement leave. If an employee would like to attend the funeral of an individual not listed in this section, upon approval and authorization of the Chief of Police or designee, the employee may do so either by using accrued vacation leave, or if the employee has no vacation leave available, leave without pay. The amount of leave set forth in section 14.1, above, will apply. The provisions of Section 15.3 requiring exhaustion of sick leave before leave without pay will not apply to Article 14. 2.
