AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, ADOPTING THE
2024 UPDATE OF THE PORT ORCHARD COMPREHENSIVE PLAN PURSUANT TO THE
STATE OF WASHINGTON'S GROWTH MANAGEMENT ACT, CHAPTER 36.70A RCW,
AND ADOPTING THE CITY OF PORT ORCHARD 2024 ZONING MAP, PROVIDING FOR
SEVERABILITY AND CORRECTIONS, AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, with the passage of the Washington State Growth Management Act in 1990 (GMA),
Chapter 36.70A RCW, local governments are required to adopt a comprehensive plan that outlines strategies
to accommodate the needs of a growing population; and
WHEREAS, the City of Port Orchard (City), Washington is a fully planning city under the state Growth
Management Act (GMA), Chapter 36.70A Revised Code of Washington (RCW); and
WHEREAS, the Washington State Growth Management Act (under RCW 36.70A.130) requires that
all cities and counties periodically take legislative action to review and, if needed, revise its comprehensive
land use plan and development regulations, including critical areas ordinance, to ensure the plan and
regulations comply with the requirements of the Washington State Growth Management Act, and;
WHEREAS, this Ordinance shows completion of the update process required under RCW
36.70A.130, and;
WHEREAS, in June 1995, the City Council adopted a Comprehensive Plan for the City of Port Orchard
and its urban growth area pursuant to the requirements set forth in the GMA; and
WHEREAS, the City of Port Orchard completed a periodic update of the Comprehensive Plan in
December, 2008; and
WHEREAS, the City of Port Orchard completed its most recent periodic update of the
Comprehensive Plan in June 2016; and
WHEREAS, the City of Port Orchard has made numerous Comprehensive Plan amendments since
2016 through the annual amendment process; and
WHEREAS, the City of Port Orchard seeks to be in compliance with the goals, policies, and procedures
of the Growth Management Act; and
WHEREAS, the City of Port Orchard has actively sought citizen input, utilizing several forms of public
informational media and outreach, in addition to the regularly noticed public meetings and public hearings;
and
WHEREAS, the City Council adopted a public participation program for the 2024 Comprehensive
Plan Update on December 13, 2022 after holding a public hearing; and
WHEREAS, on January 31, 2023, the City Department of Community Development and its consultant
held a Comprehensive Plan Update Kick-off Open House public workshop for the Port Orchard

Comprehensive Plan 2024 Update, including presentation of a project schedule and a public involvement
plan; and
WHEREAS, after the Comprehensive Plan Update Kick-off Open House public workshop, the City
Department of Community and Development supplemented public outreach efforts with an online platform,
Social Pinpoint, to allow Port Orchard residents to participate in outreach efforts at their convenience; and
WHEREAS, on July 28, 2023, in association with the Comprehensive Plan Update Kick-off Open
House, Social Pinpoint was utilized for public input; and Social Pinpoint was launched for public input related
to the Comprehensive Plan Update Kick-off Open House; and
WHEREAS, on February 6, 2024, the City of Port Orchard Planning Commission held a public meeting
to review and discuss the draft 2024 Comprehensive Plan Introduction, Economic Development, and Utilities
Elements; and
WHEREAS, on February 21, 2024, the City Council Land Use Committee held a public meeting to
review the draft Introduction, Utilities and Economic Development Elements; and
WHEREAS, on February 26, 2024, the City Council Economic Development and Tourism
Committee held a public meeting to review the draft Economic Development Element; and
WHEREAS, on February 28, 2024, a Comprehensive Plan Update Policy Workshop was held by the
Department of Community Development and its consultant to provide an opportunity for the public to
review, give feedback, and revise policy language in the City's current Comprehensive Plan; and
WHEREAS, on February 28, 2024, in association with the Comprehensive Plan Update Policy
Workshop Social, Pinpoint was utilized for public input; and
WHEREAS, on March 5, 2024, the City of Port Orchard Planning Commission held a public meeting to
review and discuss the draft 2024 Comprehensive Plan Natural Systems, Parks and Recreation, and
Transportation Elements; and
WHEREAS, on March 20, 2024, the City Council Land Use Committee held a public meeting to
review the draft Parks and Recreation, Natural Systems, and Transportation Elements; and
WHEREAS, on April 2, 2024, the City of Port Orchard Planning Commission held a public meeting to
review and discuss the draft 2024 Comprehensive Plan Land Use, Housing, Capital Facilities, and Climate
Elements; and
WHEREAS, on April 24, 2024, the City Council Land Use Committee held a public meeting to review
the draft Land Use, Housing, Climate, and Capital Facilities Elements; and
WHEREAS, on May 22, 2024, the City Council Land Use Committee held a public meeting to discuss
the draft Bethel Subarea Plans; and
WHEREAS, on June 4, 2024, the City of Port Orchard Planning Commission held a public meeting to
review and discuss the draft 2024 Comprehensive Plan Introduction, Land Use, Housing, Parks and

Recreation, Natural Systems, Economic Development, Utilities, Transportation, Capital Facilities, and Climate
Elements; and
WHEREAS, on June 4, 2024, a 2024 Comprehensive Plan Periodic Update — Draft Elements Workshop
was held by the Department of Community Development and AHBL to provide an opportunity for the public
to review and provide input on the Draft Elements of the Comprehensive Plan; and
WHEREAS, on June 4, 2024, in association with the Comprehensive Plan Update Draft Elements
Workshop, Social Pinpoint was utilized for public input; and
WHEREAS, on June 27, 2024, the City Council Land Use Committee held a public meeting to review
and discuss the draft 2024 Comprehensive Plan Introduction, Land Use, Housing, Parks and Recreation,
Natural Systems, Economic Development, Utilities, Transportation, Capital Facilities, and Climate
Elements; and
WHEREAS, on July 17, 2024, the City Council Land Use Committee held a public meeting to discuss
the Bethel Subarea Plans Alternatives; and
WHEREAS, on July 24, 2024, a 2024 Comprehensive Plan Periodic Update — Bethel Subarea Plans
Workshop was held by the Department of Community Development and its consultant to provide an
opportunity for the public to review and provide input on the draft Bethel Subarea Plans; and
WHEREAS, in association with the 2024 Comprehensive Plan Periodic Update —Bethel Subarea Plans
Workshop, Social Pinpoint was utilized for public input; and
WHEREAS, on September 11, 2024, the City Council Land Use Committee held a public meeting to
review and discuss the Draft Bethel Subarea Plans, and the Capital Facilities Element; and
WHEREAS, on September 17, 2024, the City Council held a public work-study meeting to review the
draft 2024 Port Orchard Comprehensive Plan Update; and
WHEREAS, on September 24, 2024, a Notice of Hearing was published for a public hearing to be held
by the Planning Commission on the complete draft 2024 Comprehensive Plan Update, and email notice of
the hearing and availability of the draft plan was sent to the Washington Department of Fish and Wildlife, the
Washington Department of Ecology, the Washington Department of Transportation, the Suquamish Tribe,
Kitsap County, the City of Bremerton, the City of Poulsbo, the City of Bainbridge Island, the South Kitsap School
District, the West Sound Utility District, the Puget Sound Regional Council, and South Kitsap Fire and Rescue;
and
WHEREAS, on September 24, 2024, the City Planning Department issued a SEPA Determination of
Non -Significance based on an Environmental Checklist prepared forthe adoption of the 2024 Comprehensive
Plan Periodic Update, and distributed it to Kitsap County, the City of Bainbridge Island, City of Poulsbo, the
City of Bremerton, Army Corps of Engineers, Washington Department. of Community, Trade, & Economic
Development, WA Department of Natural Resources, South Kitsap Fire & Rescue, WA Dept. of Fish &
Wildlife, the Kitsap Public Health District, Kitsap Transit, Housing Kitsap, Puget Sound Energy, Washington
Department of Ecology, Suquamish Tribe, the Washington Department of Archaeology and Historic
Preservation, Kitsap Public Utility District, West Sound Utility District, Washington State Dept. of

Transportation, Puget Sound Clean Air Agency, Kitsap Regional Coordinating Council, and Naval Base Kitsap,
and published the Determination in the newspaper and on the City website; and
WHEREAS, the Department of Community Development received one timely provided comment
from the Suquamish Tribe related to the Determination of Non -significance; and
WHEREAS, on September 25, 2024, notice of the proposed adoption of the 2024 Port Orchard
Comprehensive Plan Update was sent to the Washington State Department of Commerce at least sixty days
before the amendments were adopted, in accordance with RCW 36.70A.106; and
WHEREAS, on October 1, 2024, the draft 2024 Comprehensive Plan Introduction, Land Use, Housing,
Parks and Recreation, Natural Systems, Economic Development, Utilities, Transportation, Capital Facilities,
and Climate Elements, and appendices were sent to the Puget Sound Regional Council for review; and
WHEREAS, on October 1, 2024, the City of Port Orchard Planning Commission held a public
meeting to review and discuss the Introduction, Land Use, Housing, Parks and Recreation, Natural
Systems, Economic Development, Utilities, Transportation, Capital Facilities, Climate Elements, the
Bethel/Lund Subarea Plan, and the Sedgwick/Bethel Subarea Plan, and opened a public hearing and left
the record open through October 29, 2024; and
WHEREAS, on October 16, 2024, the City Council Land Use Committee held a public meeting to
review and discuss the Introduction, Land Use, Housing, Parks and Recreation, Natural Systems, Economic
Development, Utilities, Transportation, Capital Facilities, Climate Elements, and the Bethel/Lund Subarea
Plan, and the Sedgwick/Bethel Subarea Plan; and
WHEREAS, as of the end of the SEPA comment on October 22, 2024, no SEPA appeals had been
filed; and
WHEREAS, the Planning Commission met on October 29, 2024, to discuss public and agency
comments received from the Puget Sound Regional Council; and
WHEREAS, on October 29, 2024, the Planning Commission continued its public hearing on the 2024
periodic update to the comprehensive plan and after receiving no further testimony, closed the public hearing
on the 2024 Port Orchard Comprehensive Plan Update, deliberated, and voted six to one to recommend
approval of the draft plan to City Council; and
WHEREAS, on November 15, 2024, the City Council Land Use Committee held a public meeting to
review and discuss the Introduction, Land Use, Housing, Parks and Recreation, Natural Systems, Economic
Development, Utilities, Transportation, Capital Facilities, Climate Elements, and the Bethel/Lund Subarea
Plan, and the Sedgwick/Bethel Subarea Plan; and
WHEREAS, on November 19, 2024, the City Council held a public work-study meeting to review the
draft 2024 Port Orchard Comprehensive Plan Update and the Planning Commission recommendation; and
WHEREAS, the Department of Commerce acknowledged completion of their review of the
Comprehensive Plan on December 4, 2024, and requisite time has now passed to allow this ordinance to be
adopted; and

WHEREAS, on December 10, 2024, the City Council met to discuss the proposed 2024 Comprehensive
Plan Periodic Update at their regular meeting to consider the Planning Commission's recommendation, the
public record including public and agency comments; and
WHEREAS, the City Council deems it in the public interest to adopt the amendments to the Port
Orchard Comprehensive Plan as set forth in this Ordinance; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS:
SECTION 1. Findings. The City Council finds as follows: The amendments adopted by this ordinance
have been developed through a rigorous public process, have been reviewed under the State Environmental
Policy Act, have the recommendation of the Port Orchard Planning Commission made after holding a public
hearing, and are consistent with PRSC's Vision 2025 and the Kitsap Countywide Planning Policies, and that
Port Orchard has fulfilled requirements for the 2024 Periodic Update process as required by the Growth
Management Act pursuant to RCW 36.70A.130. The City Council adopts the recitals as additional findings in
support of this Ordinance.
SECTION 2. Extension of Critical Areas Update Deadline. The City Council finds that the
Department of Community Development has made substantial progress on the required Critical Areas
Code Update and as such, as documented by the Department of Commerce, is afforded an additional year
to complete an its update to the Critical Areas Code (POMC 20.162).
SECTION 3. Adoption of Comprehensive Plan Amendments and Appendices. In accordance with
the above -described Findings and Conclusions, the City Council hereby amends the text and maps of the
Port Orchard Comprehensive Plan by approving and adopting the following:
1. The 2024 Draft Port Orchard Comprehensive Plan Update dated December 2024, including the
revised Comprehensive Plan Map and Future Land Use Map and the wording changes incorporated
into the draft plan by the City Council on that date.
2. All appendices associated with the Comprehensive Plan:
a. AppendixA —The Comprehensive Plan Land Use Designation Map
b. Appendix B — Plans adopted by Reference, including a new 6-year and 20-year
Transportation Improvement Program
c. Appendix C — Ruby Creek Subarea Plan
d. Appendix D — Downtown Port Orchard Subarea Plan
e. Appendix E - McCormick Village Subarea Plan
f. Appendix F — Bethel Lund Subarea Plan
g. Appendix G — Sedgwick Bethel Subarea Plan
h. Appendix H —Port Orchard Housing Action Plan
i. Appendix I — Port Orchard Land Capacity Analysis
j. Appendix J — Port Orchard Racially Disparate Impacts Analysis ; and
3. The City of Port Orchard 2024 Zoning Map.
SECTION 4. Administrative Update Permitted. The City Council authorizes the Development Director
to make corrections to the Future Land Use Map in the Land Use Element for consistency with Kitsap County's
final 2024 UGA boundaries and zoning, once the County's 2024 Comprehensive Plan has been adopted.

SECTION 5. Severability. If any sentence, section, provision, or clause of this ordinance or its
application to any person, entity or circumstance is for any reason held invalid or unconstitutional, the
remainder of the ordinance, or the application of the provision to other persons, entities, or circumstances
is not affected.
SECTION 6. Corrections. Upon approval of the city attorney, the city clerk, and/or the code
publisher is authorized to make any necessary technical corrections to this ordinance, including but not
limited to the correction of scrivener's/clerical errors, references, ordinance numbering,
section/subsection numbers, and any reference thereto.
SECTION 7. Publication. This Ordinance shall be published by an approved summary consisting of
the title.
SECTION 8. Effective Date. This ordinance shall be in full force and effect five (5) days after posting
and publication as required by law. A summary of this Ordinance may be published in lieu of the entire
ordinance, as authorized by State Law.
