763970 Easement (Granted by City) - William L and Helen L Fletcher Town of Port Orchard - Contract Install CulvertA G R E E M E N T THIS AGREEMENT made this'2_ day of October, 1958, between the Town of Port Orchard (hereinafter called "Town") and WILLIAM L. FLETCHER and HELEN L. FLETCHER, his wife, (:zereinafter called "Fletchers"), W I T N E S S E T H: WHEREAS Fletchers are owners in fee simple of the following des- cribed property in Kitsap county, State of Washington, to -wit: Lots 31, 32, 33 and 34, 3lock 1, Sweaney's Second Addition to Port Orchard; and, WHEREAS, the Town desirea to install a culvert under a certain alley which runs in a northerly and southerly direction along the western boundary of the above described Fletcher property to facilitate drainage in the area surrounding the above described property; and WHEREAS, the Fletchers have no objections to the installation of said culvert so long as it is at a sufficient depth so that it won't be damaged by heavy trucks passing over the aforesaid alley; NOW, THEREFORE, it is hereby agreed as follows: 1. Fletchers agree that the Town of Port Orchard may install a culvert underneath the alley at a spot to be designated by the Fletchers, providing said culvert is at a sufficient depth so that it will not be damaged by heavy trucks passing over the aforesaid alley. 2. The Town of Port Orc_aard agrees to install the aforesaid cul- vert in a workmanlike manner, and further agrees to remove all debris from the immediate area of the culvert .after the aforesaid culvert is installed, and to leave the immediate area of the culvert in a clean and neat condition. 3.
