HomeMy WebLinkAbout015-25 - Resolution - Final Plat Approval McCormick N Village Residential EDocusign Envelope ID: 96123DBO-1734-4454-ACA9-5EO80DC7465C RESOLUTION NO.015-25 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, GRANTING FINAL PLAT APPROVAL FOR A 67-LOT (177-UNIT) AND 13-TRACT PLAT KNOWN AS MCCORMICK NORTH VILLAGE RESIDENTIAL EAST. WHEREAS, property owner McCormick Villages, LLC (hereinafter "Applicant"), has submitted an application for final plat approval of the project known as McCormick North Village Residential East on property located in the City of Port Orchard (hereinafter "the Property"); and WHEREAS, the Property is subject to a Development Agreement for traffic, recorded on October 21, 2005, as modified and recorded on February 19, 2021, Contract No. C035-21; and WHEREAS, on January 31, 2024, and February 27, 2025, the City of Port Orchard Development Director approved two Minor Plat Amendments to the McCormick North Village Residential East preliminary plat; and WHEREAS, on February 12, 2025, an application was submitted for the final plat of McCormick North Village Residential East preliminary plat, to include 67 residential lots with a total of 177 units as well as 13 tracts; and WHEREAS, City staff have reviewed the proposed final plat for compliance with the Port Orchard Municipal Code, and recommends approval subject to adequate bonding/securities in place to ensure the completion of remaining work in the event the Applicant should fail to comply with the terms of the preliminary plat approval; and WHEREAS, water service is provided by the City of Bremerton and the Director of Public Works has determined that the proposed means of sewage disposal are adequate as constructed or bonded, and recommends approval of the final plat; and WHEREAS, the City Engineer recommends approval of the final plat; and WHEREAS, the City Community Development Director recommends approval of the final plat; and WHEREAS, the Applicant has secured bonds guaranteeing completion of certain improvements required by the Preliminary Plat Approval; and WHEREAS, the City Council finds that the McCormick North Village Residential East Final Plat conforms to all terms and conditions of the preliminary plat approval, as approved by the Hearing Examiner, and that said subdivision meets the requirements of Chapter 58.17 RCW and other applicable state laws and local ordinances; and WHEREAS, the City Council finds that the McCormick North Village Residential East Final Plat conforms to the applicable zoning requirements and Port Orchard's Comprehensive Plan; now, therefore; Docusign Envelope ID: 96123DBO-1734-4454-ACA9-5EO80DC7465C Resolution No. 015-25 Page 2 of 2 THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: It is the intent of the Port Orchard City Council that the recitals set forth above are hereby adopted and incorporated as findings in support of this Resolution. THAT: The Port Orchard City Council approves the final plat for McCormick North Village Residential East, as illustrated and as legally described in Exhibit A, attached hereto; and THAT: The McCormick North Village Residential East subdivision shall be governed by the terms of approval of the final plat, and the statutes, ordinances, and regulations in effect at the time of approval for a period of five years after final plat approval, unless the City Council finds that a change in conditions has created a serious threat to the public health or safety in the subdivision. THAT: The Resolution shall take full force and effect upon passage and signatures hereon.
