RESOLUTION NO. 018-25
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
AUTHORIZING THE MAYOR TO EXECUTE WATERWAY PERMIT NO. 20-C12074 WITH THE
WASHINGTON STATE DEPARTMENT OF NATURAL RESOURCES FOR THE CONTINUED USE OF
THE DEKALB STREET PIER.
WHEREAS, the City of Port Orchard maintains a Waterway Permit with the Washington State
Department of Natural Resources (DNR) for the use of state-owned aquatic lands at the Dekalb Street Pier;
and
WHEREAS, the Dekalb Pier is part of the City's waterfront park system and provides day -use
moorage, pedestrian access, and recreational amenities to the public; and
WHEREAS, the prior Waterway Permit (No. 20-1312074) expired, and the City has coordinated with
DNR to develop a new five-year agreement —Waterway Permit No. 20-C12074—which maintains the
same general footprint and use as the previous permit with a new term through 2030; and
WHEREAS, as part of the lease renewal process, a new recorded survey was completed to
accurately describe the lease area and confirm the location and extent of public access amenities,
including the pier, gangway, moorage float, and related infrastructure; and
WHEREAS, these facilities support public access and recreational use and therefore qualify for a
no -fee lease designation pursuant to RCW 79.105.230 and WAC 332-30-131; and
WHEREAS, execution of the new Waterway Permit is necessary to ensure the continued public
benefit and authorized use of the Dekalb Pier for the term of the agreement; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS
FOLLOWS:
THAT: The City Council authorizes the Mayor to execute Waterway Permit No. 20-C12074 with
the Washington State Department of Natural Resources, allowing for the continued authorized
use and operation of the Dekalb Street Pier and associated aquatic lands through March 31,
2030.
THAT: The Mayor is authorized to undertake any and all actions necessary to implement the
provisions of the permit, including coordination with staff and DNR, to ensure the continued
maintenance, public access, and recreational use of the facility in accordance with state laws
and City policies.
