An ordinance granting the right to erect poles and stretch wires
thereon for electric purposes,
BE IT ORDAflIED BY THE COUi'CIL OF TEE TOWN OF SIDIEY, KI^:.SAP CO. VYASHI.
SECTION 1. That there be and is hereby granted unto Vim. D. Calder
and Co. and to their successors and assigns, the right, privilege and su-
thority to lacate, erect, place rtaiantain and use in the streets, alleys
and public ways of the said town of Sidney, poles with the necessary
cross -arms thereon, to fasten wires, ad atretch saidwires through said
arms and thereon to fasten wires, and to stretch) said wires through said
streets and alleys for the purpose of distributing electric currentz to
and from the different buildings and sections and protions of said town.
SECTION 2, That &ll poles to be erected as aforesaid, shall be
dressed and painted and constructed in a workmanlike manner, and, when
erected in or near a street having a sidewalk, they shall be placed in-�
side of and adjoining the outside stringer upon which the planks of such
sidewalk are laid; said poles shall not be less, than j inches in
diameter at the top, and shall be substantially set in the ground not
less than six feet and of sufficient depth to render them safe and free
from all danger of careening or falling; and all cross -arms shall be so
placed on said poles that the lowest shall not be less than twenty-four
(24) feet from the grade of the street where the streets are graded, and
if not graded, then to be not less than twenty-four (24) feet from the
gr®utd; said poles shall be located andplaced under the direction of the
'_ street committee of said town, and so placed as to not interferd with any
object or objects now lawfully existing in ay of said streets or alleys.
SECTION 3. Said wires shall be insulated and carefully connected
and fastened so as to not come in direct contact with any other object
through Which a "ground" could or might be formed, and shall be stretched
so as not to interfere with the free and unobstructed use of the said
streets and alleys.
SECTION 4 That whenever it shat 1 become necessary in the erection
of said poles to take up any portion of the sidewalk, or dig up any por-
tion of the ground in or near the sides or corners of streets or alleys
in said town, then the said Win. P. Calder and Co., or its successors or
assigns, shall after said poles are erected, without depay, replace said
sidewalk and prQperly refir the stringers and planks thereof in a neat,
workmanlike manner, and remove from said streets, sidewalks or alleys,
all rubbish, sand, and dirt or other material which may have been placed
there, taken up or dug n?p in the erection or construction of said poles,
and put such sidewalk, street, or alley in as good condition as it was
before it was taken up or disturbed.
`+;CTIOINT 5, That whenever any person has obtained permission to use
any of the streets of the city ofor the purpose of removing any building
the said company, its successors or assigns, upon forty-eight (48) hour's
notice from such person, shall raise or remove any of said wires which may
obstruct the removal of such building, so as to allww the free and unob-
structed passage of the same. Such notice shall be in writing and served
by any person competent to be a witness in a civil action upon said com-
pany, its successors or assigns, or its or their representatives or agent;
and, in case of its or their refusi to comply with such notice, the street
corn issioner shall raise or remove such wires at the expense of said com-
pany, its successors, or assigns, for the purpose aforesaid,
SECTION 6. That all the privileges herein conferred upon and grant-
ed to said company, its successors or assigns, shall continue for thirty
(5Oyears from the time this ordinance goes into effect.
SECTION 7. That the said company contracts and covenants hereby to
indemnify the said town of Sidney for any injury arising from any casual-
ty or accident to person or property by reason of any neglect or omission
to keep the said poles and wires in a safe condition, and for all valid
claims against saidtown for damages caused by said wires or electric
currents conducted thereby.
SECTION 8. When the town of Sidney shat 1 require lights for
lighting any municipal building, or room or building used for municipal
purposes, the same sh all be furnished by the said Vim. D. Calder and Co.
or their successors or assigns without coat to said town, upon thirty (30)
days noticed
SECTION 9. That said company shall, within ten (10) days from the
adoption of this ordinance file with the Town Clerk, its acceptance of
the franchise herein granted and subject to the conditions herein.
