ORDINANCE AMENDING OR iINANCES NUMBERED 634 AND 636 RESPECTIVELY WHICH RELATE TO THE ANNEXATION OF CERTAIN PROPERTY TO THE TOWN OF PORT ORCHARD ANTS THE VACATION OF CERTAIN STREETS THEREIN. WHEREAS, by Ordinance No. 634 the Council of the Town of Port Orchard, in the manner provided by law, did duly annex certain real property described in the said Ordinance to the town of Port Orchard, and did thereafter, by Ordinance number 636, vacate the Easterly 30 feet and.Southerly 1.5 feet of a street adjacent to the said property, as more fully described on a plat attached to the Ordinance and marked "Exhibit A"; and WHEREAS, through inadvertence, a portion of the description of the property owned by the said John E. Tegstrom and Marguerite E. Tegstrom was omitted from the legal descriptions set forth, in the said Ordinances numbered 634 and 636, and the said John E. Tegstrom and Marguerite E. Tegstrom have called the attention of the Council of the Town of Port Orchard to that fact and have requested that the said descriptions in the said Ordinance be amended, nunc pro tunc; and WHEREAS, the exhibits attached to both of the said Ordinances and the respective petitions of the said John E. Tegstrom and Marguerite E. Tegstrom for annexation and partial vacation included the premises respectively annexed and vacated, but which were omitted from the legal descriptions; NOW, THEREFORE, be it, and it hereby is unanimously ordained by the Council of the Town of Port Orchard, sitting in regular session, that the legal descriptions of the property set forth in Ordinances numbered 634 and 636 be and the same hereby is added to and corrected, nunc pro tunc, to read as follows: Parcel A: The West 112 feet of the following described property: The North ' of' the Northeast of the Northwest ?y of the Northwest , lying West of Mitchell Road; EXCEPT State Highway; situate in Sec. 36, Twp. 24 N., R. 1 E., W.M., Kitsap 'County, Washington. Parcel B: That portion of the Northwest k of the Northwest of the Northwest k lying East of State Highway, EXCEPT the South 165 feet; situate in Sec. 36, Twp. 24 N., R. 1 E., W.M., Kitsap County, Washington. Parcel C: Part of the northwest k of the northwest J, Sec. 36, Twp. 24 N., R. 1 E., W.M., described as follows: The West 112 feet of the north ) of the northeast k of the northwest - of the northwest J, lying west of Mitchell Road; EXCEPT highway, being approximately 85/100 of an acre, in Kitsap County, Washington. It is further unanimously ordained by the Council of the Town of Port Orchard that Parcel C above described be and the same hereby is annexed to the Town of Port Orchard, and a portion of the right of way of Highway No. 14 in the Town of Port Orchard, an unnamed street, but commonly known as the Bremerton -Gig Harbor Highway, more particularly hereinafter described, be and the same hereby is vacated, the said description being as follows: That portion of the N of the NWT of the NWT, Sec. 36, 'rwp. 24 N., R. I E., W.M., in Kitsap County, Washington, lying southeasterly of State Highway No. 14 and being more parti- cularly described as follows: Beg. at the NW corner of said Sec. 36; thence S. 89°28'44" E. along the northerly line of said Sec. 36, a distance of 664.25 feet; thence S. 0°07'57" east 195.18 feet; thence S. 8925l7" east 110.58 feet to the true point of beginning; thence north 89°25'17" west 140.66 feet to a point on a curve on southeasterly right of way of State Highway No. 14 whose. radius point bears S. 54°. 03300" east 1587.1 feet; thence northeasterly along said southeasterly right of way and along the arc of said curve 81.96 feet to a point of tangency from which the radious point .bears S. 53"0444" east 1587.1 feet; thence N. 38°55'i6" east 98.25 feet to beginning of a curve to the right having a radius of 308.1 feet and running through an angle of 1°45'07"; thence northeasterly along the arc of said curve to a point which is north 0°03west of the true point of beginning; thence S. 0°03' east to the true point of beginning, Kitsap County, Washington; TOGETHER WITH the southeasterly 30 feet and the southerly 15 feet of the said Highway adjoining Parcels A and B hereinabove described, as more particularly shown on Exhibit A attached to Ordinance No. 636.
