IT IS HEREBY 3Y ORDAINED 5'1 THE COUNCIL OF THE TOWN OF PORT ORCHARD As FOLLOWS: SECTION I: It shall be unlawful for any.:person or persons to wear a police uniform or any portion thereof within the limits of the Town of port Orchard or carry fire arms upon their person in the limits of the Town of For: Orchard without frat"obtaining a permit therefor. SECTION II: DEFINITIONS: By the term "police uniform" as herein used, is meant headgear, blouse and trousers of such a character as would lead a reasonable person to believe that the wearer thereof was a member o€ a duly constituted law enforcement agency. By the term "fire arm" as herein used, is meant any fire arm the barrel of which is less than eighteen inches long. SECTION III. APPLICATION REQUISITES AND DURATION OF PERMIT: Appli- cation for a permit to wear a police uniform or portion thereof and/or carry a firearm shall be made to the Chief of Police of the Town of Fort Orchard who shall have authority to issue the permit to the person properly applying therefor. The application shall state the name and address of the applicant, whether or not the applicant has ever been convicted of any crime, shall set forth the name and address of the applicant's last employer and the names and addresses of three persons who can attest as to the applicant's good character, and the said application shall be sworn to under oath before an officer authorized to take oaths by the laws of the State of Washington. No permit shall be issued by the Chief of Police hereunder unless he finds from the applicant's application and after an investigation of the applicant's references that the applicant is of good moral character. The permit shall continue in force after issued until revoked by the for cause or by request of the permittee. SECTION IV. REVOCATION OF PERMIT: The permit herein provided for may be revoked at any time by the Council of the Town of Port Orchard at a regular meeting after not less than five days notice in writing that a hear- ing has been set at the said regular meeting to consider the revolcation of the said permit. The said notice shall be in writing and may be served per- sonally or may be mailed by registered mail to the address of the permittee as it appears in his application on file in the office of the Chief of Police of the Town of Port Orchard. SECTION V. PENALTIES: Any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof, may be punished. by a fine not to exceed $100.00, or by imprisonment for any time not exceeding 30 days, or by both such fine and imprisonment. SECTION VI. EXCLUSIONS: This Ordinance shall not apply to any duly constituted law enforcement officer in the regular employ of the '=own of Port Orchard, the County of Kitsap, any incorporated municipality of the State of Washington, the State of Washington or any sub -division thereof, or the United States of America.
