ANN ODINANCE RELATING TO HOLIDAYS, VACATIONS AIM SICK LEAVE FOR EMPLOYEES OF THE TOWN OF PORT 0I IAM BE IT oaai&BY THE G 3iMSCIL OF THE TOWN OF PORT ORCHARD AS FOLLC : Section 1. Definitions: In construing the provisions of the ordi- nance, the following definitions shall apply A. A, full tiresemployee means any persons employed by the Town of Port Orchard cd o devotes his full time to his job during working hours, on a year round basis. S. A part t#x employee means any •,person employed by the Town of Part Orchard who.dsiotes only a part of his time during working hours to the service for the. Tosan or who spends full time during working hours for the Town, but is hiredon the basis of less than year round work. C. Saturdays, if worked, shall be considered to be a working day. D. "Holidays shall be observed as defined by Washington State Law, RCW 1.16.05:0 which reads as follows: 'Leal Holidays. The following are legal holidays: Sudsy the first day of January, commonly called New Year's Day; the twenty-second day of February, being the anniversary of the birth of George i shi; t a; the thirtieth day of May, commonly known as Memorial Day; the fourth day of.July, being the anniversary of the Declaration of Independence; the first Monday in .Septer, to be knoFan as Labor Day; the eleventh day of November, to • be known es.Veteranal Day; the twenty-fifth day of December, commonly called Christmas Dey;,and any day designated by public proclamation of the chief execu- tive of the atate as a legal holiday, or as a day of thanksgiving. • E. Anything herein to the contrary notwithstanding, a department heart shall have the right and authority to require one or more of the employees in his dep*rtmeut to. work on a holiday as herein defined. Each full time employee, � after completingmon ths six calendar of continuous ersloymeat, shall be entitled to vacation with pay as follows: One day per month, butnotto exceed one calendar week. One additional day for each additional calendar month for service in excess of six months, providing, bow - ever, that no vacation shall exceed four calendar weeks. • E. For employees entitled to twelve working days or two calendar weeks' vacation, at least 6 consecutive of the twelve (or one calendar wok) •mast be taken at one time, and remaining calendar week or 6 or less may be taken a day or tare at a time, subject to approval of the department head. C. Any full time employee who will have completed six calendar piths r or more of continuous employment shall receive upon leaving the employ of the Town vacation pay for 5' portion of vacation earned, but not taken, provided, however, that the pay sll not exceed twelve days or two calendar weeks' pay • • for any period of service. • D. Section ..> S:ick Leaves A. All full time employees of the To of Port Orchard shall be en:_ titled to sick- leave pay when :her are incapacitated for the performance of their duties by reason of sickness or injury, or when through exposure to con- tapious diseases, tsar presence of the employee would J&opardize the health of ot.`>?ars Such sick leave shall be at the rate of one day for each calendar :onthi of employaen't„ and if not e13ed, shall accumulate t..7 a maximum of thirty worktg days. S. Sick leave and vacation time shall be accumulated and recorded on. a calendar year basis, ,. Sickness shall be reported at the beginning of any period of ill- ness to t ..e immedia: t; supervisor, and within three days after returning to work, the employee shall give a written statement, explaining the nature of his sick- ness and submit a real request for approval of leave so taken, which request, when approved by the department head, shall be filed in personnel file kept i the office of the s epartmant head. D. A doctores certificate will be furnished at the discretion of the department head when the sick leave extends over a period of three days. S. Pare time employees shall not be entitled to sick leave. F. G. Any employee found to have abused the sick leave privilege by fal- sification or misrepresentation may thereupon be subject to dismissal upon re- cormendation o€ the department head and at the discretion of the Town Council. H. In case of injuy, or illness which is covered by industrial insur- ance, the amount of insurance payments will be deducted from the next re�ular pay received by the employee. I. At the option of the employee, sickness in excess of the aim number of days accrued may be charged to unused vacation. Section 4. Civil Leaves Ut • •.1 Any necessary leave may be allowed by the head of the department to permit any employee to serve as a member of the jury, or to exercise his other' civil duties. Each employee who is granted such leave, and who, for the per- formance of the civil duties involved, received any compensation, shall be paid by the TOW1 for the tine he is absent, only in the amount of excess of his regular 4 salary over the compensation so received. Section S. Military Leaves: Leave not to exceed fourteen calendar days in any period of twelve con- secutive months, over and aboveannual vacation shall be allowed any y employee who is a member of any duly established National Guard or Reserve Corps unit. The employee will be paid for the period of the lease, less the amount of the base pay received by him for his active duty training, and proof o€ the amount and re- ceipt of the base pay for such service shall be made in such manner and upon such certificate as the State Auditor of the State of Washington shall require. Section 6. General A. Section 8.
