AN ORDINANCE PROVIDING
FOR THE IMPROVEMENT OF
DIVISION STREET FROM A
POINT 138 FEET WEST OF MAN-
HOLE AT INTERSECTION OF
CLINE AND DIVISION STREETS
TO THE IN,'ERSECION OF DIV-
ISION A-ND'AYh:ST STREETS.AND
FOR. THE IMPROVEMENT OF
WEST STREET FROM THE SAID
INERSECTION, NORTH TO THE
INTERSECTION OF WEST AND
BAY STREETS FOR THE CON-
STRUCTION AND INSTALLATION
OF SANITARY SEWERS IN AC-
CORDANCE WITH RESOLUTION
NO. 54-2 OF THE COUNCIL OF
THE TOWN OF PORT ORCHARD,
CREATING A LOCAL IMPROVE-
MENT DISTRICT AND PROVID-
ING THAT PAYMENTFOR THE
SAID IMPBOVEMENT BE MADE
BY SPECIAL ASSESSMENT ON
THE PROPERTY IN THE SAID
DISTRICT, PAYABLE IN THE
MANNER PROVIDED BY LAW.
BE IT ORDAINED BY THE
COUNCIL OF THE TOWN. OF
PORT ORCHARD:
SECTION 1. That Division Stre-
et from a point 138 feet West of
the manhole at the intersection
of Cline and Division Streets, to
the intersection of Division and
West Streets, and West Street,
from. the said Intersection of Div.
ision and West Streets North to
the intersection of West Street
and Bay Street, all in the Town
of Port Orchard, be improved by an
installation of sanitary sewers and
appurtenances, according to plans
and specifications prepared there-
for by the Engineer of the Town
of Port Orchard and approved by
the Council.
SECTION 2. That the costs and
expenses of said iprovements, in-
cluding all necessary and inci-
dental expenses, shall be borne by
and assessed against the property
thus charged in the assessment
district hereinafter created in ac-
cordance with law. The Town of
Port Orchard shall not be liable
In any manner for any portion of
the costs and expenses of said im-
provements.
SECTION 3. That there is here-
by established a local improve-
ment district to be called "Local
Improvement District No. 56•", the
boundaries of which district are
hereby specified and described as
follows, to -wit:
Beginning at a point in the alley
6 ft. south of the southwest cor-
ner of Lot 3, Block 1, W E.
Smith's Add. to Port Orchard;
thence West 426 ft. to the west
margin of West St., thence
north along the west margin of
West St., 192 ft. to the north
line of Division St., thence west
120 ft., thence north 186.5 ft.
to the east margin of High'Ave.,
thence' north 38.15' east along
the east margin of High Ave. 194
ft. to its intersection with the
west margin of West St., thence
north 272.5 feet to the center
line of DeKalb St., produced,
thence east along the center line
of DeKalb St. produced 66 ft.
to the east margin of West St.,
thence south 161 ft. to the cent-
er of the- alley in block 2, Sid-
ney, thence east 60 ft., thence
south 322 ft. to the center of the
alley in block 1, Sidney, thence
east 360 ft., thence south be-
tween lots 14 and 15, block 1,
Sidney 161 ft. to the center line
of Division St., thence west 60
ft., thence south 159 ft. to the
place of beginning, Kitsap
County. Washington.
SECTION 4. The cost and ex-
pense of the improvement shall be
borne by the said improvement
district and, exclusive of any por-
tion borne by either the State of
Washington or other government
agency shall be assessed against
such property included in the im-
provement district in proportion to
the said area, except any units
wherein the special benefits con-
ferred upon the property are not
reflected by the termini and zone
method, the assessment shall 'be
made against the property of the
district or any unit within the
district in accordance with the,
special benefits it will derive from
the improvement without regard
to the zone and termini method, in
accordance with the provisions of
Sections 35.43.220 and 35,44.010,
Revised Code of Washington, the
remainder of the said cost of the
Improvement to be paid for by
arrangement, if any, with either
the State of Washington or other
government agency.
SECTION 5. Warrants shall be
issued in payment for the work
and improvements provided in this
ordinance and same shall be al-
lowed to run at the interest rate
of 4% per annum until funds re-
ceived in payment of assesments
and interest thereon accumulate
in any month to a sum sufficient
to pay the next succeeding war-
rant, together with interest there-
on, at which time the town Treas-
urer shall call in as many war-
rants and pay the accumulated
interest thereon as the funds in
his hands permit. Assessments
shall be payable in full, or, at the
option of the assessed property
owners, in ten equal annual in-
stallments with interest at the
rate of 4% per annum on the un-
paid installments: Due date of as-
sessments or installments thereof
shall be fixed by the Town Clerk
in the manner provided by law.'
Interest shall be computed for an
even number of months at all
times; all fractional parts of a
month to be considered a full
month. Penalties on account of
assessments becoming delinquent
shall be assessed at the rate of 5%
of the total amount due, regard-
less of how short a time the as-
sessment remains delinquent.
SECTION 6. Thisordinance shall
be in full force and effect five
days after its passage, approval
and publication in the official
paper of the Town of Port Orchard.

SEWER LINE
NOTIC IS HEREBY GIVEN
that town •of Port Orchard

tructi of"a sanitary sewer line
until 7:30' P. 3I., Monday, July 25,
1955, at the council chambers of
the Town of Port Orchard,. --Port
Orchard City Hall, at which 'time
all bids will be opened and pub-
licly read aloud. The items to be
furnished are as follows:
1. Furnish and install approxi-
• mately 1,050 lineal feet of 8
inch cement or clay pipe with
15 Y's.
2. Furnish and instal' three
manholes.
3. Furnish and install 1. amp
hole.
Bidders and -or contractgrs are
notified to examine thoroughly
the bid instructions, proposals, the
form of contract, plans and speci-
fications. If there be any doubt
or obscurity as to the meaning of
the same, intended bidders or con-
tractors should ask the Engineer
of the Town of Port Orchard for
an explanation of same before
submitting their proposal and -or
aceepti'sng their contract.
Each bid shall be in accordance
with the plans and specifications
now on file, at the . office. of the
Clerk of the -Town. of Port Or-
chard, Port Orchard City Hall,
Port Orchard, Washington, where
copies may be obtained by de-
positing $5.00 for each set of spec-
ifications and contract drawings.
This deposit will be refunded to
all plan holders if the contract
plans and specification's are re-
turned in good condition within
five days after bid opening. Each
bid shall be accompanied by a
certified check payable to the
Treasurer of the Town of Port
Orchard in an amount equal to
5% of the bid.
The Town of ,Port Orchard re-
serves the right to reject any and
all bids or waive any informali-
ties in the bidding.
No bidder may withdraw his
bid for a period of thirty days
after the date set for the opening
thereof.
