ORDINANCE NO. 144.
AN ORDINANCE providing for the improvement of Sidney Street, from
• the North margin of Division Street to the South margin of ieicher Street
in the Town of Port Orchard, by clearing, grubbing and grading said street
to a uniform width of 30 feet between curbs, and creating an assessment
district for the payment of said improvement as provided by the laws of
• the State of Washington.
ti BE IT ORDAIE D by the Council of the Town of Port Orchard:
Section 1,
That Sidney Street from the North margin of Division Street to the
South margin of Melcher Street in the Town of Port Orchard, be improved
by clearing, grubbing and grading said street to a uniform width of 30
feet between curbs, according to the official grade for said street and
the profile, plans and specifications prepared under the direction of the
Tom Council of said Town, and on file in the office of the Town. Clerk,
Section II.
That said improvement shall be done by contract and let to the lowest
responsible bidder after at least seven days1 notice, which said notice
shall be posted or published in the same manner as the ordinances of the
to= are posted or published, and which said notice shall specify the
time and place of opening the bids for said improvement, and provide that
all bidders must make a deposit of a certified check olawful money of
the United States of at least ten per cent of the amount of the bid to se-
cure the said contract if awarded to the bidder, and said notice shall
contain the farther provision that any or all bids may be rejected by the
Town Council,
Lc: Section III.
The bidder to whom said contract is awarded shall enter into a written
�t contract with said Town in accordance with said bid., and give a good and
sufficient bond to the said Town in amount equal to said bid, conditioned
that said contractor shall carry out and perform all conditions of said
contract and pay for the labor and material used therein, Said improve --
vent to be done in a worhanlike manner and subject to the approval and
hre acceptance of said Town Council, and shall be completed within such reason-
able time as said Council may designate in the said contract.
Section fro
That the mode. of making payment to the contractor for such improve"
ment shall be by warrants drawn on the Street Improvement Fund for the
district hereinafter named, Said warrants may be issued from time to
time during the progress of the work for any amo-int not exceeding seven--
• ty-five per cent of the contract price for the proportionate amount of
the work then completed as estimated by the City engineer. Said warrants
shall be issued in suns not to exceed Fifty 050.00) Dollars, and shall
draw interest at the rate of ten (10) per cent per annum from the date
e L that the assessment made for said improvement begins to draw interest, un-
• til there is sufficient money in said fund with which to pay said warrants
• which said warrants shall be paid in the order of their issue.
• Section V.
The cost and expenses of making said improvement shall be assessed
against the several lots, pieces or parcels of land to the full depth
thereof, fronting or abutting the aforesaid portion of said Sidney Street
• especially benefitted by said improvement, in proportion to the benefits
derived from said improvement, and which said property is hereby estab
fished and designated as "Local. Improvement District, Sidney :street; Year
1.
Section VI.
The space formed by the junction of two or more streets or where one

main street terminates in or crosses another main street shall be paid
by said Towno
Section VII.
After the completion of said improvement the Town Council of said
Town shall view the lots, pieces or parcels of land fronting or abuttin,
on said street, and after deducting the cost of street intersections shill
divide the corts and expenses of said improvement among the lots, piece,
or parcels of land especially benefitted, in proportion to the benefits
derived. therefrom by eachlot, piece or parcel of land as aforesaid, and
then instruct the Clerk to prepare an assessment roll to be known as ".t -
sessment Roll for Local Improvement District, Sidney Street, Year 1909,'
showing the amount assessed against each lot, piece or parcel of land brat
efitted by said improvement in proportion to the benefits.
Section VIII.
The Town Council, upon the receipt of said assessment roll, shall
cause notice to be posted or published. in the same manner as the ordinane
of the,Town are posted or published, at least seven days, notifying all
persons interested that said roll has been prepared and filed, and requi_
them to appear at the time and place specified in said notice, not later
than ten days from the date of said notice, to make objections, if any
they have, to said assessment, and the Town Council at the time fixed in
said notice shall consider any and all objections made, and shall make
such corrections on said roll as it may deem just and proper. The Town
Council shall then by ordinance approve said assessment roll and shall
levy and assess the amount thereof against each lot, piece or parcel of
land on said roll, and shall certify such levy as corrected, against sac]
lot, piece or parcel of land, and declare the same a lien thereon and di,
reet the Clerk to deliver to the Treasurer of said Town the said assessm.

to collect the same in the manner provided by law, and give notice that
the said assessment roll is in his hands for collection as hereinafter
providede
Section IX.
That upon the receipt of said assessment roll by the Town Treasures
the said assessment shall become due and collectible, and if the amount
of any assessment is not paid within thirty days from the date of the no
tics given by the said Treasurer, as hereinafter specified, the said as-
sessment shall draw interest at the rate of ten per cent per annum, and
if said assessment shall. not be paid within sixty days from the date of
said notice a penalty of ten per cent shall be added thereto, and said a-
sessment shall then to deemed delinquent and shall be collected by fore-
closure suit in the manner provided by law, and the property, or so much
thereof as may be necessary, sold to raise the amount of the assessment
not paid as aforesaid, together with interest, penalty and costs, includ'
ing an attorney's fee of Twenty-five (25.00) Dollars in each foreclosure

Section X.
That within three days after the receipt of the assessment roll by
the Town Treasurer, he shall proceed to give notice in writing by mail
to each property owner named in said roll, which said notice shall be ad-
dres+te
to the last known place of residence of said property owners, an

and amount of the assessment, and shall also state that if said as-
sessment is not paid within thirty (30) days from the date of such noti'
the said assessment will bear interest at the rate of ten per cent per
annum, and if not paid, within Misty (60) days from the date of such n -
tiee a penalty of ten per cent will be added. to said assessment, and t
same will then become delinquent and will be collected by foreclosure
suit as provided by law and ordinances of said Town. Said Treasurer,
shall, after giving notices as directed by this ordinance endorse upo:

said assessment roll the date when said assessments become delinquent,
and when so endorsed shall be the dates from which interest and penalty
shall be computed upon said assessment.
Section XI.
That this ordinance shall take effect and be in force from and after
its passage and publication according to law.
