AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
ADOPTING A NEW CHAPTER 3.90 ("DONATION ACCEPTANCE") TO
THE PORT ORCHARD MUNICIPAL CODE; PROVIDING FOR
SEVERABILITY; AND SETTING AN EFFECTIVE DATE.
WHEREAS, on July 21, 2017, the classification of the City of Port Orchard changed
to that of Non-Charter Code City; and
WHEREAS, the reclassification of the city necessitated certain additions to the Port
Orchard Municipal Code ("POMC"); and
WHEREAS, the City Council has determined that it is in the best interests of the
city to adopt Chapter 3.90 POMC as a necessary addition to the POMC as a result of the
reclassification; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN
AS FOLLOWS:
Port Orchard Municipal Code Chapter 3.90 ("Donation Acceptance") isSECTION 1.

Chapter 3.90 - DONATION ACCEPTANCE
Sections:
3.90.010 Administration.
3.90.020 Use.
3.90.030 Acceptance.
3.02.010 Administration.
The finance director or his/her designee shall have the responsibility for the
administration of all donations to the city.
3.02.020 Use.
In the event a donor has indicated a desire for a particular use by the city of a donation,
such donation shall, to the extent reasonably feasible, be used consistent with the donor's
desired use. If a donor has not specified a particular desired use, the donation may be
used for any municipal purpose.

3.02.030 Acceptance.
All monetary and nonmonetary donations with a current value greaterthan five thousand
dollars must be approved by the city council prior to acceptance. The finance director or
his/her designee shall estimate the value of any nonmonetary donation not supported by
a bona fide appraisal, for purposes of compliance with this section.
SECTION 2. Severability. If any section, sentence, clause or phrase of this Ordinance
should be held to be unconstitutional or unlawful by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this Ordinance.
SECTION 3. Publication. This Ordinance shall be published by an approved summary
consisting of the title.
SECTION 4. Effective Date. This Ordinance shall take effect and be in full force and effect
five days after publication, as provided by law.
PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor and
attested by the Clerk in authentication of such passage this 12th day of December 2017.
