001-17 - Ordinance - Amending Chapter 5.32 Related to Carnivals and Provision to Assess a Fire District Review FeeORDINANCE NO. 001-17 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, AMENDING PORT ORCHARD MUNICIPIAL CODE SECTIONS 5.32.010 (LICENSE REQUIRED); 5.32.040 (LICENSE FEE FOR CARNIVAL); AND 5.32.060 (APPLICATION FOR LICENSE AND INFORMATION REQUIRED) TO ADD PROVISIONS TO ASSESS A FIRE DISTRICT REVIEW AND INSPECTION FEE; PROVIDING FOR SEVERABILITY AND PUBLICATION; AND SETTING AN EFFECTIVE DATE. WHEREAS, the City Council deems it in the best interests of the City of Port Orchard to periodically review and update the City's administrative fees; and WHEREAS, on December 13, 2016, the City Council passed Resolution No. 081- 16, which provides, among other things, that the City assess a Fire District Review and Inspection Fee on applications for carnival licenses; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. The Port Orchard Municipal Code, Section 5.32.010, is hereby amended to read as follows: 5.32.010 License required. It is unlawful for any person or persons, company, corporation or association to do, transact, exercise, engage in or carry on, either directly or indirectly, within the corporate limits of the city any trade, occupation, business or activity for which a license is required or a license fee provided, as in this chapter specified, without first procuring such license, paying such fee, and passing a Fire District review and inspection. SECTION 2. The Port Orchard Municipal Code, Section 5.32.040, is hereby amended to read as follows: 5.32.040 License fee for carnival. The proprietor or manager of every carnival shall pay a license fee equal to $100 for each day for which application is made and a one-time $100 Fire District review and inspection fee for each application. SECTION 3. The Port Orchard Municipal Code, Section 5.32.060, is hereby amended to read as follows: 5.32.060 Application for license and information required. Before any person shall operate any amusement licensed under the provisions of Ordinance No. 001-17 Page 2 of 2 this chapter, he shall apply in writing to the city council for a license therefor and pay the license and Fire District review and inspection fees provided in this chapter. The application shall specify: (1) The name of the person, firm, or corporation which will use the structure; (2) The location of the principal place of business of such person, firm, or corporation; (3) The names and addresses of the officers of such firm or corporation; (4) The length of time the license is intended to be used for the purpose applied for; (5) Nature of activity to be conducted; (6) Such other relative information as the city council may require. SECTION 4. Severability. If any section, sentence, clause or phrase of this Ordinance should be held to be unconstitutional or unlawful by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this Ordinance. SECTION 5. Publication. This Ordinance shall be published by an approved summary consisting of the title. SECTION 6. Effective Date. This Ordinance shall take effect and be in full force and effect five days after publication, as provided by law.
