AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
RELATING TO WATER -SEWER CAPITAL FACILITY CHARGES AND
AMENDING CHAPTER 13.04 OF THE PORT ORCHARD MUNICIPAL
CODE TO THE SAME EFFECT; PROVIDING FOR SEVERABILITY AND
CORRECTIONS; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Port Orchard and Ms. Katy Isaksen of Katy Isaksen and Associates Inc.
completed the Capital Facilities Charge (CFC's) update which was presented to Council and Staff
on November 15th 2016 with regards to amending Chapter 13.04.025 POMC; and
WHEREAS, the City of Port Orchard, through the water and sewer gap analysis and an
updated Capital Improvement Plan (CIP), now have the ability to amend Chapter 13.04.025
POMC, thereby updating the City's CFC's and allowing for a fiscally constrained CIP; and
WHEREAS, at the December 18, 2016 City Council meeting, the matter was discussed
further, and upon which the Port Orchard City Council directed Staff to bring forth the
proposed amendment to Chapter 13.04.025 POMC at a future Regular Council Meeting for
action; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS
FOLLOWS:
SECTION 1. Findings. The City Council adopts all of the "Whereas" sections of this Ordinance as
findings in support of this Ordinance .
. SECTION 2. Amended Chapter 13.04.025 POMC Adopted. Amendments to Chapter 13.04.025
of the Port Orchard Municipal Code (POMC) are hereby adopted as follows:

SECTION 3. Severability. If any section, sentence, clause or phrase of this Ordinance should be
held to be unconstitutional or unlawful by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of any other section,
sentence, clause or phrase of this Ordinance.

SECTION 4. Publication. This Ordinance shall be published by an approved summary consisting
of the title.
SECTION 5. Effective Date. This Ordinance shall take effect and be in full force and effect five
days after publication, as provided by law.
PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor and
