AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
AMENDING THE BIENNIAL BUDGET FOR THE YEARS 2017 - 2018
AS ADOPTED BY ORDINANCE NO. 040-16 TO RECOGNIZE
EXPENDITURES AND REVENUES NOT ANTICIPATED AT THE TIME
OF THE ADOPTION OF THE 2017 - 2018 BIENNIAL BUDGET.
WHEREAS, the City of Port Orchard adopted its 2017 - 2018 Biennial Budget in
Ordinance No. 040-16 and subsequently amended by Ordinance No. 010-17; and
WHEREAS, the City desires to keep current on budget amendments; and
WHEREAS, it is necessary to make adjustments to accounts and/or Funds by means of
appropriation adjustments that could not have been anticipated at the time of passage of the
2017 - 2018 Biennial Budget, as provided in RCW 35.33.091 and RCW 35.33.121; andI
WHEREAS, the city is engaged in designing, acquiring, and constructing the
Bay Street Pedestrian Path, a part of the regional mosquito fleet trail system, and the city
budgeted in 2016 for the acquisition of land and easements for property adjacent to existing
City owned right-of-way, that will serve as public access; and

WHEREAS, negotiations to purchase the property and easements extended past the end
of 2016 and into 2017, with the 2016 budget appropriation expiring on December 31, 2016, and
the 2017 budget not including an appropriation for such, recognizing that the Recreation and
Conversation Office grant expires on June 17, 2017; and
WHEREAS, the city desires a budget amendment to include in the 2017 - 2018 Biennial
Budget those amounts contemplated for the purchase of easements and property and not
otherwise expended in 2016; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS
FOLLOWS:
The 2017 - 2018 Biennial Budget is amended to reflect theSECTION 1.
following:
(1) Estimated Revenues:

a) $98,830.00 grant funding for property purchase to Street Capital Projects Fund
No. 304
b) $118,670 to Street Capital Projects Fund No. 304 for property purchase from
Real Estate Excise (REET) Fund No. 109.
c) $7,500 to Street Capital Projects Fund No. 304 for property purchase from City
Street Fund No. 002
(2) Estimated Appropriations:
a) $225,000 from Street Capital Projects Fund No. 304 for property purchase.
SECTION 2. Severability. If any section, sentence, clause or phrase of this Ordinance
should be held to be unconstitutional or unlawful by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this Ordinance.
SECTION 3. Publication. This Ordinance shall be published by an approved summary
consisting of the title.
SECTION 4. Effective Date. This Ordinance shall take effect and be in full force and
effect five days after publication, as provided by law.
