018-17 - Ordinance - Amending Chapter 13.04 Water and SewersORDINANCE NO. 018-17 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, RELATING TO WATER - SEWER PLAN REVIEW AND INSPECTION FEES AND POLICIES AND AMENDING CHAPTER 13.04 OF THE PORT ORCHARD MUNICIPAL CODE TO THE SAME EFFECT; PROVIDING FOR SEVERABILITY AND CORRECTIONS; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City of Port Orchard wishes to provide the explicit authority within the Port Orchard Municipal Code for fees related to the review and inspection of water and sewer system improvements; and WHEREAS, the City's permitting process and permitting requirements were recently updated; and WHEREAS, the City wishes to ensure that developers that construct water and sewer system improvements pay the costs associated with plan review and inspections; and WHEREAS, the City of Port Orchard City Council finds that the proposed fee structure and policies will cover the cost of water and sewer system plan review and inspections; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. Findings. The City Council adopts all of the "Whereas" sections of this Ordinance as findings in support of this Ordinance. SECTION 2. Amended Chapter 13.04.025 POMC Adopted. Amendments to Chapter 13.04.025 of the Port Orchard Municipal Code (POMC) are hereby adopted as follows: 13.04.025 Fee schedule. SECTION 3. A new section 13.04.031 is adopted. A new section 13.04.031 Water System and Improvements of the Port Orchard Municipal Code (POMC) are hereby adopted as follows: 13.04.031 Water system extensions and improvements. All water system extensions and/or improvements shall be reviewed, approved, and inspected by City staff or selected representatives in conjunction with the submittal of an Excavation Permit (POMC 12.04), Land Disturbing Activity Permit (LDAP) Ordinance No. 018-17 Page 5 of 6 and/or Stormwater Drainage Permit (SDP) application(s) as may be required under other sections of this code prior to the starting of construction on the proposed water system improvement. Review fees for water system extensions or improvements shall be paid in addition to required application fees for the above mentioned permits. Water system extension and improvement inspection fees shall be paid prior to permit issuance. Fees associated with the construction of significant facilities shall be determined at project completion and paid prior to project acceptance. All review and inspection fees shall be charged as set forth in POMC 13.04.025. SECTION 4. A new section 13.04.031 Water System and Improvements of the Port Orchard Municipal Code (POMC) are hereby adopted as follows: 13.04.045 Sewer system extensions and improvements. If any section, sentence, clause or phrase of this Ordinance should be held to be unconstitutional or unlawful by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this Ordinance. SECTION 6. Publication. This Ordinance shall be published by an approved summary consisting of the title. SECTION 7. Effective Date. This Ordinance shall take effect and be in full force and effect five days after publication, as provided by law.
