025-17 - Ordinance - Amending the Budget for 2017-2018ORDINANCE NO. 025-17 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, AMENDING THE BIENNIAL BUDGET FOR THE YEARS 2017 - 2018 AS ADOPTED BY ORDINANCE NO. 040-16 TO RECOGNIZE EXPENDITURES AND REVENUES NOT ANTICIPATED AT THE TIME OF THE ADOPTION OF THE 2017 - 2018 BIENNIAL BUDGET. WHEREAS, the City of Port Orchard adopted its 2017 - 2018 Biennial Budget in Ordinance No. 040-16 and subsequently amended by Ordinance No. 010-17 and Ordinance No. 013-17; and WHEREAS, the City desires to keep current on budget amendments; and WHEREAS, it is necessary to make adjustments to accounts and/or Funds by means of appropriation adjustments that could not have been anticipated at the time of passage of the 2017 - 2018 Biennial Budget, as provided in RCW 35.33.091 and RCW 35.33.121; and WHEREAS, the City engaged in design and right of way acquisition for the Tremont Widening Project which now has a reached the construction phase with the authorization of a construction contract with Active Construction, Inc., and the construction amount was not known at the time of adoption of the 2017 - 2018 Biennial Budget, and WHEREAS, the City contemplated project and construction expense and successfully sought funding partners that provide, a Transportation Improvement Board $8,000,000 grant; a Federal Highway Administration $1,744,727 grant; and a $2,000,000 LEAP project appropriation within Engrossed Senate Bill 5096; and the remainder to be paid from proceeds of a City of Port Orchard Limited Tax General Obligation Bond and from Water - Sewer Utility Fund No. 401; and WHEREAS, the City expects to start construction activity with a ground-breaking ceremony in July, and construction to follow that will result in project expense, it is necessary to recognize by budget ordinance Tremont Widening Project revenue and expense; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: The 2017 - 2018 Biennial Budget is amended to reflect theSECTION 1. following: (1) Estimated Revenues: a) $1,744,727, grant revenue from Federal Indirect Grant (Washington State Dept, of Transportation/Federal Highways Administration) to Street Capital Projects Fund No. 304. Ordinance No. 025-17 Page 2 of 3 b) $8,000,000, grant revenue from Washington State Transportation Improvement Board to Street Capital Projects Fund No. 304 c) $2,000,000, grant revenue from Washington State LEAP, project appropriation within Engrossed Senate Bill 5096 to Street Capital Projects Fund No. 304. d) $498,245, revenue from Water Sewer Utility Fund No. 401. e) $5,800,000 from proceeds of City of Port Orchard Limited Tax General Obligation Bond to Street Capital Projects Fund No. 304. (2) Estimated Appropriations: a) $17,544,727, from Street Capital Projects Fund No. 304 for the Tremont Widening Project. b) $498,245 from Water Sewer Utility Fund No. 401 SECTION 2. Severability. If any section, sentence, clause or phrase of this Ordinance should be held to be unconstitutional or unlawful by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this Ordinance. SECTION 3. Publication. This Ordinance shall be published by an approved summary consisting of the title. SECTION 4. Effective Date. This Ordinance shall take effect and be in full force and effect five days after publication, as provided by law.
