027-17 - Ordinance - New Chapter 1.22 City Wayfinding LogoORDINANCE NO. 027-17 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, CREATING A NEW CHAPTER IN THE PORT ORCHARD MUNICPAL CODE 1.22 (CITY WAYFINDING LOGO); PROVIDING FOR SEVERABILITY; AND SETTING AN EFFECTIVE DATE. WHEREAS, the City Council has determined to adopt a City wayfinding logo for use in promoting City services and City-related activities and events; and WHEREAS, the City has registered the logo as a City trademark under the laws of the State of Washington, Chapter 19.77 RCW; and WHEREAS, the City Council would like to officially acknowledge the wayfinding logo as a City trademark and establish policies for its use by City staff and third parties who are granted permission to use the logo via a trademark license agreement; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. A new Chapter 1.22 is hereby created as follows: Chapter 1.22 CITY WAYFINDING LOGO Sections: 1.22.010 1.22.020 1.22.030 PURPOSE. DEFINITIONS. USE POLICY. 1.22.010 Purpose. The city has adopted an official wayfinding logo for the city of Port Orchard to be used by city staff to promote city services. The city may also make this logo available to individuals, entities and organizations that wish to use it as a promotional tool to attract visitors and encourage tourism to the city and participation in city-related activities and events, as deemed appropriate by the mayor or his/her designee. The purpose of this chapter is to set guidelines to ensure the logo will be used and displayed appropriately. 1.22.020 Definitions. "Port Orchard wayfinding logo" shall mean the logo adopted by the city council as the official wayfinding logo of the city of Port Orchard. 1.22.030 Use policy. Use of the Port Orchard wayfinding logo by city staff shall conform to the internal logo use policies Ordinance No. 027-17 Page 2 of 2 established by the city council to ensure consistent use of the logo to promote city services. Use of the logo by third parties shall be in accordance with the external logo use policies established by the city council, as well as such party's trademark license agreement with the city, to ensure consistent use of the logo to promote city-related activities and events and to protect the city's trademark rights in the logo. SECTION 2. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity of constitutionality of any other section, sentence, clause or phrase of this ordinance. SECTION 3. This ordinance shall be in full force and effect five (5) days after publication as required by law. A summary of this Ordinance may be published in lieu of the entire ordinance, as authorized by State Law.
