AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
ADOPTING A NEW CHAPTER TO TITLE 10 ("VEHICLES AND TRAFFIC") OF
THE PORT ORCHARD MUNICIPAL CODE TO ESTABLISH A DESIGNATED
GOLF CART ZONE; PROVIDING FOR SEVERABILITY; AND SETTING AN
EFFECTIVE DATE.
WHEREAS, the Revised Code of Washington (RCW) 46.08.175 authorizes the Port Orchard
City Council to create a Golf Cart Zone for the purposes of permitting the incidental operation of
golf carts upon a street of the State of Washington under certain circumstances; and
WHEREAS, the Port Orchard City Council finds that it is in the best interests of the citizens
of the City of Port Orchard to authorize a Golf Cart Zone within the McCormick Woods
neighborhood; to establish certain regulations relating to the Golf Cart Zone; and to provide for
penalties for violations of these regulations; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS
FOLLOWS:
SECTION 1. A new Port Orchard Municipal Code Chapter 10.50 entitled "Golf Cart Zone" is hereby
adopted and shall read as follows:
10.50.010 Golf carts - Defined.
"Golf cart" means a gas-powered or electric-powered four-wheeled vehicle originally designed
and manufactured for operation on a golf course for sporting purposes and has a speed
attainable in one mile of not more than twenty (20) miles per hour. A golf cart is not a non
highway vehicle or off-road vehicle as defined in RCW 46.04.365 and RCW 46.09.310.
10.50.020 Golf carts authorized.
Subject to the provisions of this chapter and RCW 46.08.175, the operation of golf carts is hereby
authorized upon the public roadways of the development commonly known as McCormick
Woods as more fully designated and set forth on file with the City of Port Orchard ("McCormick
Woods Golf Cart Zone"). Golf carts are not permitted on non-motorized nature or hiking trails
within the IVIcCormick Woods development, which is not part of the McCormick Woods Golf Cart
Zone.
10.50.030 Obedience to rules of the road/traffic control devices.
Any person operating a golf cart upon the public roadways as authorized in this chapter shall be
subject to all of the duties and obligations applicable to the operator of a motor vehicle as per
the Washington model traffic ordinance (Chapter 308-330 WAC). In addition, operation of a golf

cart within the Golf Cart Zone must take place within the main roadway, with the exception that
operators may temporarily move to the shoulder, which is also used by pedestrian and bicycle
traffic, to allow automobile traffic to pass.
10.50.040 Additional requirements.
Any person operating a golf cart within the McCormick Woods Golf Cart Zone shall comply with
the following:i
(1) Vehicle Operator License. No person may operate a golf cart unless such person carries upon
his or her person a valid Washington State vehicle operator's license.

(2) Daylight Operation. No person may operate a golf cart at any time from a half hour after
sunset to a half hour before sunrise.
(3) Vehicle Type. A golf cart must be electric-powered to be operated within the Golf Cart Zone.
An exception is hereby made for gasoline-powered maintenance and operations carts operated
by the McCormick Woods Golf Course.i
(4) Equipment Requirements. A golf cart must meet the equipment requirements of RCW 46.08,
RCW 46.37 and 49 CFR 571.500 for reflectors, seat belts and rear view mirrors.
(5) Insurance. No person may operate a golf cart unless the person is covered under a liability
policy with liability limits of at least the amounts provided in RCW 46.29.090.
10.50.050 Violation - Penalty.
Any person who violates any of the provisions of this chapter shall be guilty of a civil infraction
resulting in a $50.00 fine.
SECTION 2. Severability. If any section, sentence, clause or phrase of this Ordinance
should be held to be unconstitutional or unlawful by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this Ordinance.
SECTION 3. Publication. This Ordinance shall be published by an approved summary
consisting of the title.
SECTION 4. Effective Date. This Ordinance shall take effect and be in full force and effect
five days after publication, as provided by law.
PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor and
attested by the Clerk in authentication of such passage this 12th day of September 2017.
