040-17 - Ordinance - Amending Chapter 2.60 Compensation for City Council Members! i ORDINANCE NO. 040-17 i AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, AMENDING CERTAIN PROVISIONS OF CHAPTER 2.60 ("COMPENSATION FOR CITY COUNCIL MEMBERS") OF THE PORT ORCHARD MUNICIPAL CODE; PROVIDING FOR SEVERABILITY; AND SETTING AN EFFECTIVE DATE. WHEREAS, on July 21, 2017, the classification of the City of Port Orchard changed to that of Non-Charter Code City; and I WHEREAS, the reclassification of the city necessitated certain revisions to the Port Orchard Municipal Code ("POMC"); and ! WHEREAS, the City Council has determined that it is in the best interests of the city to amend certain provisions of Chapter 2.60 POMC to adopt the necessary revisions to that section of the POMC that resulted from the reclassification; now, therefore, i i THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAINj AS FOLLOWS: SECTION 1. Port Orchard Municipal Code Section 2.60.010 ("Per- meeting rate") is hereby amended to read as follows: 2.60.010 Per-meeting rate. City council members shall receive compensation in the amount of $1,000.00 per month.).I j Port Orchard Municipal Code Section 2.60.030 ("Non- attendance") is hereby amended to read as follows: SECTION 2. 2.60.030 Nonattendance. No single council member may be excused for more than four meetings per calendar year (not to include illness and job conflict nonattendance). Acceptable excuses shall be: (a) Vacation; (b) Bereavement; (c) Unusual or unforeseen circumstances such as serious illness in the family, accident, or transportation carrier delay. i (2) In the event a council member misses four or more consecutive meetings, the council shall appoint a committee of three council members to meet with the subject council member to discuss that member's ability to perform the duties of that office and then i ! i I Ordinance No. 040-17 Page 2 of 2 return a recommendation to the whole council as to the continued retention of that member in the council. SECTION 3. Severability. If any section, sentence, clause or phrase of this Ordinance should be held to be unconstitutional or unlawful by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this Ordinance. SECTION 4. Publication. This Ordinance shall be published by an approved summary consisting of the title. SECTION 5. Effective Date. This Ordinance shall take effect and be in full force and effect five days after publication, as provided by law.
