ORDINANCE NO. 041-17
AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
ADOPTING A NEW CHAPTER 3.02 ("BIENNIAL BUDGET") TO THE
PORT ORCHARD MUNICIPAL CODE; PROVIDING FOR
SEVERABILITY; AND SETTING AN EFFECTIVE DATE.
I WHEREAS, on July 21, 2017, the classification of the City of Port Orchard changed
to that of Non-Charter Code City; and

WHEREAS, the reclassification of the city necessitated certain additions to the Port
Orchard Municipal Code ("POMC"); and
WHEREAS, the City Council has determined that it is in the best interests of the
city to adopt Chapter 3.02 POMC as a necessary addition to the POMC as a result of the
reclassification; now, therefore,

THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN
i AS FOLLOWS:

SECTION 1. Port Orchard Municipal Code Chapter 3.02 ("Biennial Budget") is
hereby adopted as follows:i
Chapter 3.02 - BIENNIAL BUDGET

3.02.020 Review and modification.

3.02.010 Established.
Pursuant to RCW 35A.34.040, the city council hereby establishes a two-year biennium
budget for the city of Port Orchard beginning with the two-year biennium which begins
January 1. The biennial budget and all subsequent budgets shall be prepared, considered
and adopted under the provisions of this chapter and Chapter 35A.34 RCW, which is
hereby adopted by reference.
3.02.020 Review and modification.
Pursuant to RCW 35A.34.130, the city council hereby provides for a mid-biennial review
and modification of the biennial budget no sooner than eight months after the start of
the first year of the fiscal biennium nor later than the conclusion of the first year of each
biennium. The city shall prepare proposed budget modifications to be effective as of
January 1 of the following year. Such proposed modifications shall be sent to city council

members and shall be a public record and available to the public. A public hearing shall
be advertised at least once and shall be held at a city council meeting no later than the
second Tuesday in December and may be continued from time to time. At such hearing
or thereafter, Council may consider a proposed ordinance to carry out such modifications,
and said ordinance shall be subject to other provisions of Chapter 35A.34 RCW.
SECTION 2. Severability. If any section, sentence, clause or phrase of this Ordinance
should be held to be unconstitutional or unlawful by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this Ordinance.
SECTION 3. Publication. This Ordinance shall be published by an approved summary
consisting of the title.
SECTION 4. Effective Date. This Ordinance shall take effect and be in full force and effect
five days after publication, as provided by law.
PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor and
attested by the Clerk in authentication of such passage this 24th day of October 2017.
