AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON, ADOPTING A NEW 2017 ZONING MAP TO
IMPLEMENT THE 2017 AMENDMENTS TO THE
COMPREHENSIVE PLAN; AND ESTABLISHING AN EFFECTIVE
DATE.

WHEREAS, on May 9, 2017, the Port Orchard City Council (the "City Council")
approved Ordinance 017-17, which adopted the City of Port Orchard's (the "City") 2017
Zoning Map; and

WHEREAS, on June 13, 2017, the Port Orchard City Council adopted ordinance
019-17 establishing a new unified development code, including Chapter 20.30.030, which
states that "no change shall be made to a zoning map except by authority of an amending
ordinance. Any changes made otherwise shall be in violation of this title"; and
!WHEREAS, the City may annually adopt amendments to the City's Comprehensive
Plan pursuant to RCW 36.70A.470 and 36.70A.106; and
1 WHEREAS, the City prepared a Land Use Map amendment submittal and text
amendment submittal by the required deadline date of June 15, 2017; and
WHEREAS, the Land Use Map amendment submittal proposed revisions to the
land use designations of approximately 236 properties located throughout the city; and
WHEREAS, a number of these land use designation revisions required
corresponding revisions to zoning designations, so that the City's Land Use Map and
Zoning Map remain consistent with each other; and
WHEREAS, on August 11, 2017, the City's SEPA official issued a determination of
non-significance for the proposed adoption of the 2017 land use and zoning revisions, and
there have been no appeals; and
WHEREAS, on September 5, 2017, the Planning Commission held a duly-noticed
public hearing on the proposed adoption of the 2017 land use and zoning revisions, and
public testimony was received, and the Planning Commission recommended approval of
the proposed adoption; now, therefore,

THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN
AS FOLLOWS:
SECTION 1. The City Council adopts all of the "Whereas" sections of this ordinance as
findings in support of this ordinance.

SECTION 2. Zoning Map Adopted. The City Council hereby adopts a new 2017 Zoning
Map as attached hereto as attachment as Exhibit 1 pursuant to POMC 20.30.030, replacing the
Zoning Map adopted pursuance to Ordinance 017-17.
SECTION 4. Severability. If any section, sentence, clause or phrase of this Ordinance
should be held to be unconstitutional or unlawful by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this Ordinance.
SECTION 5. Publication. This Ordinance shall be published by an approved summary
consisting of the title.
SECTION 6. Effective Date. This Ordinance shall take effect and be in full force and effect
five days after publication, as provided by law.
PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor and
attested by the City Clerk in authentication of such passage this 14th day of November 2017.
