AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
APPROVING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE
CITY OF PORT ORCHARD AND THE PORT ORCHARD POLICE GUILD
RELATING TO A CHANGE IN DENTAL AND VISION BENEFITS; PROVIDING
FOR SEVERABILITY AND PUBLICATION; AND SETTING AN EFFECTIVE
DATE.
WHEREAS, the two existing collective bargaining agreements between the City
of Port Orchard ("City") and the Police Guild ("the Guild"), relating to Patrol Officers and
Sergeants, provide that the Guild members shall continue to be covered for dental and
vision insurance through the Teamsters Health and Welfare Trust through the end of
2018; and
WHEREAS, the Teamsters Health and Welfare Trust no longer offers dental and
vision insurance to the Police Guild members as of July 1, 2018, since they are no longer
members of Teamsters 589, and accordingly the City and the Guild agreed to reopen
negotiations on the sole issue of health insurance to bargain over a suitable alternative
to the dental and vision insurance plans; and
WHEREAS, the City has secured alternative dental and vision insurance from
AWC to cover Guild members, called the Delta Dental Plan J and VSP zero deductible,
which are very similar, but not identical, to the Teamsters Health and Welfare Plan; and
WHEREAS, the Guild has agreed to accept the Delta Dental Plan J and VSP zero
deductible (beginning July 1, 2018) for 2018 only, as set forth in a signed Memorandum
of Understanding, dated July 16, 2018; and
WHEREAS, the parties further agree that all other terms and conditions set forth
in the current CBAs and any amendments thereto will remain in full force and effect;
now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION 1. The Port Orchard City Council approves the attached Memorandum
of Understanding between the City and the Police Guild relating to the change in dental
and vision benefits in the manner described above and authorizes the Mayor's signature
on said Memorandum of Understanding.
SECTION 2. Severability. If any section, sentence, clause or phrase of this
Ordinance should be held to be unconstitutional or unlawful by a court of competent

jurisdiction, such invalidity or unconstitutionality shall not affect the validity or
constitutionality of any other section, sentence, clause or phrase of this Ordinance.
SECTION 3. Publication. This Ordinance shall be published by an approved summary
consisting of the title.
SECTION 4. Effective Date. This Ordinance shall take effect and be in full force and
effect five days after publication, as provided by law.
PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor and

Memorandum of Understanding
Amended to the AGREEMENTS by and between
CITY OF PORT ORCHARD, WASHINGTON
and
PORT ORCHARD POLICE GUILD
(Representing Patrol Officer and Sergeant Employees)
dated
January 1,2016 through December 31, 2018
THIS AMENDMENT is supplemental to the AGREEMENTS by and between the CITY
OF PORT ORCHARD, WASHINGTON (the “City”) and the PORT ORCHARD
POLICE GUILD (the “Guild”) (representing Patrol Officer and Sergeant Employees),
which are effective January 1, 2016 through December 31, 2018.
WHEREAS, the parties’ Collective Bargaining Agreements (“CBAs”) referenced
above provide for the reopening of negotiations to address the Dental and Vision plan
change that took effect July 1, 2018; and
WHEREAS, the parties wish to memorialize this agreement as an amendment to
the CBAs;
NOW THEREFORE, the City and the Guild have entered into this Memorandum
of Understanding (“MOU”) to memorialize the following agreement:
For the period of July 1 through December 31, 2018 only, the following revisions
to Section 15 of both the Patrol Officer and Sergeant CBAs will apply:
ARTICLE 15 HEALTH AND WELFARE
The Employer shall purchase Dental Plan “J” through Association of Washington Cities (AWC)
Dental, for the employee, spouse and dependents if such coverage is available to the Guild through
AWC. In the event that such coverage is not available to the Guild, the parties agree to re-open
this Agreement for the singular purpose of bargaining the dental benefits to be provided under this
Article 15.
15.2
The Employer shall remit an amount per person per month (person means employee) equal to the
basic Vision Plan named “VPS no deductible” for the employee, spouse and dependents if such
coverage is available to the Guild through AWC. In the event that such coverage is not available
to the Guild, the parties agree to re-open this Agreement for the singular purpose of bargaining the
vision benefits to be provided under this Article 15.
15.3
All employees that have Dental Plan “J” and Vision Plan “VSP no deductible” through the
Association of Washington Cities (AWC) must meet the eligibility threshold and be compensated
for at least thirty (30) hours per month to qualify for the above benefits as per City policy. If the
employee does not meet the eligibility requirement, then they are not entitled to the benefits or
alternative compensation for the same.

The parties agree that the compensation set out in this MOU, an amendment to the
parties’ CBAs, fairly compensates Guild employees for the referenced dental and vision
health care plan changes.
