INTERLOCAL AGREEMENT
REGARDING JOINT USE OF PARKING AREA
ON CITY RIGHT-OF-WAY
This Agreement made this C;?3 day of 1992, by and
between Kitsap County, hereinafter County, the City of Port Orchard, hereinafter City, both
municipal corporations organized and existing under the laws of the State of Washington, and
the Pony/Colt League, Inc., a private corporation, is to provide for a joint use agreement for
joint use of a parking area located on City right-of-way.
RECITALS
Whereas, the County owns real property referred to herein as the Givens Site, located
on Sidney Street, Port Orchard, Washington between Kendall and Sroufe Streets, as set forth
on attached Exhibit A;
Whereas, the City owns a sixty foot (60') right-of-way along the west side of the Givens
Site from Kendall Street to Sroufe Street as depicted on Exhibit A;
Whereas, the Pony/Colt League, Inc. leases from the City property located to the west
of the west border of the Givens Site;
Whereas, the City, County, and Pony/Colt League, Inc., will benefit from additional
parking at the Givens Site;
AGREEMENT
Now therefore, it is hereby agreed: _
(1) The City will allow the County to use the right-of-way described above for
purposes of constructing additional parking for the Givens Site. Said parking is as described on
Exhibit A.

(2) City and Pony/Colt League, Inc. agrees to allow a small portion of the property
leased to the Pony/Colt League, Inc., to be used to complete the parking area as shown on
Exhibit A.
(3) The County agrees to create approximately fifty (50) additional parking spaces
along the above -described right-of-way and other portions of the Givens Site.
(4) County agrees not to interfere with any other leases or uses previously entered
into between the City and the Pony/Colt League, Inc.
(5) County agrees to perform routine maintenance of the right-of-way. Routine
maintenance will be limited to sweeping of the paved portions of the right-of-way. The right-of-
way will remain under the control of the City. This control will include parking enforcement,
asphalt repairs, striping, and storm drainage maintenance.
(6) The term of this Agreement shall be for a period of five (5) years. Upon the
expiration of five (5) years the Agreement will automatically renew for consecutive one (1) year
periods thereafter unless terminated by either party upon giving six (6) month notice prior to the
expiration of each period.
(7) The parties agree that the parking area to be developed by the County may be
jointly used by all parties. In the event there is a conflict in uses, County shall be first in order
of priority, then the Pony/Colt League, Inc., and then the City.
(8) County agrees to list the City as an additional insured with respects to the terms
and conditions of this agreement.
(9) County agrees to provide an emergency access route through the right-of-way.
(10) County agrees to maintain security lighting along the improved portion of the
right-of-way during functions held at the Givens Site.
