MEMORANDUM OF UNDERSTANDING
RE: Maintenance of the Slopes of Cuts, Fills and Embankments
The purpose of this memorandum of understanding is to define
responsibilities of the City of Port Orchard Public Works and the
Washington State Department of Transportation (WSDOT) for
maintenance of slopes within the right of way of State Roads 160
and 166. Reference is made to the Revised Code of Washington
47.24.020, paragraph 6.
In that the City of Port Orchard has a population of less than
15,000 and proper maintenance of the right of way drainage system
affects public safety, WSDOT has the authority to assume the
expense and responsibility for the stability of slopes of cuts and
fills and the embankment within the right of way of State Roads 160
and 166.
The WSDOT shall maintain the slopes of cuts and fills and
embankment within the right of way of State Roads 160 and 166.
During an unusual event such as a landslide after a heavy rain, the
City of Port Orchard Public Works shall promptly respond to the
scene of the landslide if other emergencies within the City do not
prohibit it. If the City Public Works Department arrives before
WSDOT, the City shall clear the roadway to allow the traffic to
resume. WSDOT shall clean up the site and re-establish the
integrity of the road drainage system as soon as WSDOT can schedule
this work.
Through this cooperation between the City and the Washington
Department of Transportation, adverse impacts to the motorists can
be minimized and traffic safety enhanced.
Either party can cause this memorandum to be null and void by
informing the other party in writing of his intent to cancel the
memorandum of understanding.
