THIS LEASE is between KITSAP BANK, a Washington corporation, and the
undersigned (hereinafter referred to as "Lessee").
KITSAP BATTK hereby leases to Lessee 14 parking stall(s) in the parking
lot commonly known as 620 Bay Street, Port Orchard, Washington, subject to the
following terms and conditions:
1. RENT: Lessee shall pay rent in the amount of $23.00 per month
due and payable on the first day of each month. If this Lease is effective other
than the first day of a month, rent shall be prorated for the month of December, 1998
in the amount of $10.00 per stall.
2. TERM: This Lease is a month -to -month tenancy. Either party may
terminate this Lease by giving the other party no less than thirty (30) days
advance written notice.
3. USE: The parking stall is leased for use by Lessee for vehicle
parking purposes only. Lessee agrees to restrict Lessee's use to that purpose
and not to use, or permit the use of the parking stall for any other purpose
without the prior written consent of KITSAP BANK. Lessee shall not conduct any
business activities in the subject parking lot.
4. LIABILITY INSURANCE: Lessee shall procure and maintain in force
during the term of this Lease and any extension thereof, at the sole expense of
Lessee, liability coverage acceptable to KITSAP BANK adequate to protect KITSAP
BANK against liability for damage claims arising out of accidents occurring in
or around the parking stall and subject parking lot. Lessee shall provide a copy
of said liability coverage to KITSAP BANK.
5. LIABILITY: KITSAP BANK shall not be liable for liability or damage
claims to persons, including Lessee or the agents or employees of Lessee, or for
any property damage from any cause, or from theft or losses to Lessee, related
to Lessee's occupancy of the parking stall and subject parking lot. Lessee shall
indemnify and hold KITSAP BANK harmless against any and all losses or other
damage claims or obligations because of or arising out of such injuries or
losses.
6. DEFAULT: If Lessee fails to pay the monthly rent by the loth day of
each month, KITSAP BANK has the right, at its option, to cause the vehicle of
Lessee to be towed from the subject parking lot, at Lessee's sole expense, and
to immediately cancelk this Lease.
7. ATTORNEY FEES: If either party files an action to enforce this
Agreement, the prevailing party is entitled to reasonable attorney fees and
costs. Venue shall be in Kitsap County, Washington.
