AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON, AMENDING THE BUDGET FOR
THE YEAR 2015 AS ADOPTED BY ORDINANCE NO.
020-14 TO RECOGNIZE EXPENDITURES AND
REVENUE NOT ANTICIPATED AT THE TIME OF
THE ADOPTION OF THE 2015 BUDGET.
WHEREAS, the City of Port Orchard adopted its 2015 Budget in Ordinance No.
020-15; and
WHEREAS, the City desires to keep current on budget amendments; and
WHEREAS, it is necessary to make adjustments to accounts and/or funds by
means of appropriation adjustments that could not have been anticipated at the time of
passage of the 2015 Budget, as provided in RCW 35.33•091 and RCW 35.33.121; and
WHEREAS, the City entered into contract No. 083 - 13 a Development
Agreement with Sinclair, LLC for the Southwest Sidney Plaza Development which
allowed the Developer a credit against the Sewer Capital Facilities charge equal to the
design, engineering, and construction costs of the Sewer Facilities that was not provided
at the time of the application of water and/or sewer connection permit processing; and
WHEREAS, the City recognized the need to amend contract No. o83- 13
recognizing the need to provide a reimbursement for the Sewer Capital Facilities charge
paid by the Developer and not credited at the time of application; and
WHEREAS, there is a need to acknowledge that the First Amendment to the
Development Agreement between the City of Port Orchard and the Sinclair, LLC for the
Southwest Sidney Plaza Development changes nine apartment buildings to ten
apartment buildings with no increase in the number of units; and
WHEREAS, the Sewer Capital Facilities charge consists of two components: the
general facilities fee and the wastewater treatment facility fee which are accounted for in
two separate City funds and a together comprise the Sewer Capital Facilities Charge;
now, therefore,

THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
DO ORDAIN AS FOLLOWS:
SECTION 1. The 2015 Budget is amended to reflect the following:
(1) Estimated Appropriations:
a. $38o,000 from the Cumulate Reserve for Water Sewer Fund No. 403 for the
general facility fee component of the Sewer Capital Facility Charge for
Developer reimbursement.
SECTION 2. This ordinance shall be in full force and effect five (5) days after
posting and publication as required by law. A summary of this Ordinance may be
published in lieu of the entire ordinance, as authorized by State Law.
PASSED by the City Council of the City of Port Orchard, APPROVED by the
Mayor and attested by the Clerk in authentication of such passage this 24th day of
February, 2015.

RECOGNIZE EXPENDITURES AND REVENUE NOT ANTICIPATED AT THE TIME OF
THE ADOPTION OF THE 2015 BUDGET

Upon written request a statement of the full text of the Ordinance will be mailed to any interested person without
