ECOLOGY FOR THE MARINA PUMP STAT ON REBU tD PROJECT;
PROV DING FOR SEVERAB LITY AND PUBL CATION; AND SETT NG AN
EFFECT VE DATE.
WHEREAS, in 2Ot7, the City's Public Works Department applied for State Fiscal
Year 2OL9 (SFY19) funding through the Department of Ecology's Clean Water State
Revolving Fund (CWSRF) for the Marina Pump Station Rebuild Project (MPSRP); and
WHEREAS, on December !2, 20L7, West Sound Utility District (WSUD) provided
the City with a letter of support for the MPSRP; and
WHEREAS, on January L9,2OL8, Ecology notified the City that the City's MPSRP
Application was determined to be eligible to compete for funding and that the Project
was ranked adequately to receive funding; and
WHEREAS, on December L3, 2OL8 the City received the Draft Loan Agreement
for the Project (WQC-2019-PoOrPW-00025) and provided comments back to Ecology;
and
WHEREAS, the City Counci! has determined it to be in the best interests of the
City to enter into Contract No. C011-10 with Ecology for the MPSRP; now, therefore,
THE CITY COUNCIL OF THE C TY OF PORT ORCHARD, WASH NGTON, DO
ORDAIN AS FOLLOWS:
SECTION 1. Contract No. C011-10 with the Department of Ecology for the Marina Pump
Station Rebuild Project is hereby approved and the City agrees to be bound by the terms and
conditions thereof in their entirety.

should be held to be unconstitutional or unlawful by a court of competent jurisdiction, such
invalidity or unconstitutionality shal! not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this Ordinance.
SECTION 3. Publication

This Ordinance shall be published by an approved summary
attested by the Clerk in authentication of such passage this 19th day of Februa

SECT ON 4. Effective Date. This Ordinance shall take effect and be in full force and

AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
ACCEPTING TERMS AND CONDITIONS ASSOCIATED WITH DEPARTMENT
OF ECOLOGY (ECOLOGY) CWSRF LOAN AGREEMENT NO. WQC-2019-
PoOrPW-00025, THEREBY APPROVING CONTRACT NO C011-19 WITH

PROVIDING FOR SEVERABILITY AND PUBLICATION; AND SETTING AN
EFFECTIVE DATE.
Copies of Ordinance No. 007-19 are available for review at the office of the City Clerk of the City of Port Orchard.
Upon written request, a statement of the full text of the Ordinance will be mailed to any interested person without
charge. Thirty days after publication, copies of Ordinance No. 007-19 will be provided at a nominal charge.
