DATE.
WHEREAS, in November 20L7, the City Council adopted Ordinance No. 046-17,
establishing a mixed use pilot program (MUPP) to promote transit oriented mixed-use
development in the City's downtown and local centers in accordance with its Comprehensive
Plan goals and policies; and
WHEREAS, the MUPP term was established as April 2,2OIB through June 30, 2019 to
allow time for development agreements to be submitted under the terms of the program; and
WHEREAS, the City Council has determined that the length of this term has not been
sufficient to allow for such development agreements to be submitted, and has therefore
determined that it is in the City's best interests to extend the term of the MUpp for an additional
calendar year; now, therefore,
THE CITY COUNCIT OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN
A5 FOTLOWS:
SECTION 1. The City Council hereby amends the MUPP expiration date, set forth in
section 2 of ordinance 046-17, from June 30, 2019 to June 30, zo2o.
sEcTloN 2. Severabilitv. lf any section, sentence, clause or phrase of this ordinance
should be held to be unconstitutionat or unlawful by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this Ordinance.
SECTION 3. Publication. This Ordinance shall be published by an approved summary
consisting of the title.
SECTION 4: Effective Date. This ordinance shall be in full force and effect five (5) days
after posting and publication, as required by law. A summary of the Ordinance may be published
in lieu of the entire Ordinance, as authorized byState Law.
