ORDINANCE NO. 015-25
AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON RELATING TO
DESIGNATED SHARED STREETS; ADOPTING A NEW CHAPTER 12.38 IN THE PORT
ORCHARD MUNICIPAL CODE TO ESTABLISH THE AUTHORITY TO CREATE SHARED
STREETS, THE APPLICABLE STANDARDS THEREOF, AND DESIGNATING SW
ASHWOOD STREET AS A SHARED STREET; PROVIDING FOR SEVERABILITY AND
CORRECTIONS; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, RCW 46.61.197 gives cities the authority to designate a shared street on a
nonarterial highway; and
WHEREAS, the City's Comprehensive Plan calls for the City to "create lively and attractive
places on a human scale;" and
WHEREAS, the McCormick Village Subarea Plan calls for the City to create "woonerf"
streets (a form of shared street) within that subarea; and
WHEREAS, the City seeks to identify and designate certain segments of streets where
vehicular traffic shall yield the right-of-way to any pedestrian, bicyclist, or operator of a
micromobility device on the shared street; and
WHEREAS, RCW 46.61.415 gives local authorities the ability to establish a maximum
speed limit of 10 miles per hour on a shared street as defined in RCW 46.61.197 and does not
need to be determined on the basis of an engineering and traffic investigation if other procedures
are adopted for establishment; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS
FOLLOWS:
SECTION 1. Findings and Recitals. The recitals set forth above are hereby adopted and
incorporated as findings in support of this Ordinance.
SECTION 2. A new Chapter 12.38 is hereby added to the Port Orchard Municipal Code to
read as follows:

12.38.010 Procedures for establishing Shared Streets,
City streets are eligible to be designated as a "shared street" regulated under this chapter when
such streets meet the following criteria:
1. Street segments are eligible when the number of pedestrians/cyclists is likely to exceed
the number of vehicles during most days of the week and hours of the day, the need for
delivery access and the presence of on -street parking is minimal, and the segment is less
than 975 feet in length.
2. Transit route streets are eligible under the condition that the City consults with Kitsap
Transit regarding the shared streets status prior to designation.
3. Prior to designation as a shared street, the street shall have some of the following features
installed: textured pavement, flush curbs, pinch points allowing one-way traffic, a defined
entrance with signage, pedestrian level illumination, and planters/trees/street furniture
placed to create protected zones for pedestrians. Residential shared streets shall have a
minimum of two of the features in this subsection to be eligible for the shared street
designation. Commercial/mixed-use shared streets shall have at least four of the features
in this subsection to be eligible for the shared street designation.
4. The City Engineer recommends such designation for the street after consulting the Fire
Code Official.
5. The City Council may by ordinance declare and establish City Shared Streets that meet the
criteria in this section.
12.38.020 Shared Streets Designated.
The following streets are established as Shared Streets.

SW Ashwood Street The entire length of the street
12.38.030 Shared Streets Speed Limit.
It shall be unlawful for the operator of any vehicle to operate the same at a speed in excess of ten
miles per hour on a shared street when such street is fully posted with speed limit signs.
SECTION 3. Corrections. Upon the approval of the city attorney, the city clerk and/or
code publisher is authorized to make any necessary technical corrections to this ordinance,

including but not limited to the correction of scrivener's/clerical errors, references, ordinance
numbering, section/subsection numbers, and any reference thereto.
SECTION 4. Severability. If any section, subsection, paragraph, sentence, clause, or
phrase of this ordinance is declared unconstitutional or invalid for any reason, such decision shall
not affect the validity of the remaining parts of this ordinance.
SECTION 5. Effective Date. This ordinance shall be published in the official newspaper of
the city and shall take full force and effect five (5) days after the date of publication. A summary
of this ordinance in the form of the ordinance title may be published in lieu of publishing the
ordinance in its entirety.
PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor and attested
