HomeMy WebLinkAbout066-25 - Resolution - Reversion of Solid Waste OversightDocusign Envelope ID: D0EC00DB-89E3-4715-831C-55EA9066B55E RESOLUTION NO. 066-25 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, APPROVING THE REVERSION OF SOLID WASTE OVERSIGHT TO THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION (WUTC). WHEREAS, since the 1970s, the City of Port Orchard has maintained a contract with a qualified solid waste hauler to provide solid waste services within the City; and WHEREAS, the City of Port Orchard entered into a Solid Waste Contract with Waste Management of Washington, Inc. in 2015, with an initial five-year term through June 30, 2020; and WHEREAS, since 2019, the contract has been extended multiple times, most recently through a Fifth Amendment adopted in May 2025, which allows services to continue only until October 30, 2025; and WHEREAS, with the expiration of the current extension approaching, the City must determine its long-term approach to solid waste oversight; and WHEREAS, the Washington Utilities and Transportation Commission (WUTC) regulates solid waste rates for most jurisdictions in Washington through a transparent ratemaking process that requires cost justification, public notice, and consumer input before any rate increases are approved; and WHEREAS, Kitsap County has already transitioned to WUTC oversight, demonstrating the effectiveness of this regulatory model within the region; and WHEREAS, the City Council finds that reverting oversight to the WUTC is the most feasible and sustainable option to ensure long-term affordability and rate stability for Port Orchard residents; THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: It is the intent of the Port Orchard City Council that the recitals set forth above are hereby adopted and incorporated as findings in support of this Resolution. THAT: The Mayor is authorized to take all necessary steps to implement this action, including preparation and submission of a letter to the WUTC, and execution of documents, providing notice to Waste Management of Washington, Inc., and coordinating with the Washington Utilities and Transportation Commission and Waste Management of Washington to facilitate the transition.
