CALL TO ORDER: Commissioner McKlosky called the meeting to order at 6:01 p.m. and led the Pledge of Allegiance. 2. PUBLIC COMMENTS: There were two members of the public present in the chamber, and the single remote attendee did not request the floor. Consequently, there were comments regarding issues with accessibility on mobile devices to access the public website. In addition to difficulty with email comments to the commission for comprehensive plan update. 3. APPROVAL OF MINUTES FROM MARCH 5, 2024: AS Commissioners Morrison and Fontenot were not present for the April meeting, they abstained from the vote approving the minutes from May's meeting. Commissioner McKlosky asked if the other commissioners had reviewed the minutes from the April 2024 meeting and if anyone had any issues or proposed amendments. Seeing none, a motion was entertained to approve the minutes. Commissioner Bailey moved to approve the minutes with Commissioner Stewart as a second. The motion passed unanimously with two abstentions. 4. BUSINESS ITEMS A. DISCUSSION: 2024 COMPREHENSIVE PLAN PERIODIC UPDATE. Principal Planner Fisk informed the commission that there were no new materials within the provided packets, but that City staff had taken the Commission's comments and public comments for the ten draft elements that have been presented. A comment matrix has been developed to respond to those submitted comments, and those comments would be incorporated into the revised draft Plan, considered within other parts of the Plan, or would not be included. Fisk mentioned that the City is currently in the process of completing the subarea drafts for the Bethel Subarea Plans, with both the subarea draft and the comment matrix being presented to the commission at the June Planning Commission meeting. Planner Fisk invited commission members to participate in the Land Use Workshop on May 9, 2024, for feedback on the Land Use and Housing Elements. The June meeting would be in a Workshop format, with revised drafts for the comprehensive plan elements to be presented publicly, providing additional opportunity for public comment prior to a public hearing. Fisk stated that City staff would like to schedule the public hearing on the Comprehensive Plan elements as a special Planning Commission meeting for the last week of June, following the workshop meeting in early June. To keep the City on track to adopt the Plan by the end of the year, and to submit the City's 60 -day notice of intent to the Department of Commerce, likely to occur in August. Additionally, Planner Fisk informed the Commission that the Department anticipates presenting the first draft of the Critical Area's Ordinance for introduction in June. Commissioner Wright asked about comments the Department has received on the draft elements, specifically whether there was any clarification needed by staff for feedback received, if the comments were clear enough. Planner Fisk replied that if there is any clarification needed, that staff would reach out at that time. Commissioner Fontenot asked about the status of public comments, whether earlier public outreach earlier in the process has resulted in an upward trend of comments from the general public. Commissioner Wright questioned whether the commission would have enough time to review the subarea plans drafts. Principal Planner Fisk replied that the review would be hurried, emphasizing that Commerce grant deliverables are due to Commerce by June 15. B. DISCUSSION: MIDDLE HOUSING OPTIONS MEMORANDUM. Chair McKlosky opened the topic for discussion at 6:14 p.m. Principal Planner Fisk provided an overview of recent legislative developments and the impact on housing in Port Orchard. Fisk informed Commissioners of House Bill 1110 and the subsequent trailer bill which followed in 2024, House Bill 2321. Stating how the laws created mandates for the permitting of multiple dwelling on a lot, in the form of middle housing and how these changes would affect the existing city code. Commissioner Wright questioned how the changes to zoning resulting from the new law would affect already developed home lots, and whether it would require homeowners to build middle housing. Planner Fisk in response explained that for developments with covenants in place that requirement could be restricted, but the City could still issue the permit, and any dispute between the homeowner and the homeowner association would be a civil matter that the City would not be party to. Commissioner Bailey asked to clarify that the City would not be party to any civil matter between an HOA and homeowner in relation to the middle housing law. Planner Fisk reiterated that the City would not be party to any such civil matter. Commissioner Bailey asked if as an owner of a large lot, could she as a homeowner build a single- family home. Planner Fisk responded by affirming that she as a homeowner could. Commissioner Wright then added that, if the homeowner was to sell that property, the new owner could, if they chose to, build two ADU's, no matter what neighbors or the HOA might think. Director Bond Page 2 of 3 replied that the law would grant deference to the HOA covenants, but that it would be up to the HOA to enforce those covenants. C. DISCUSSION: DIRECTOR'S REPORT Director Bond reported that the City Council has authorized the City Clerk to schedule parliamentary procedure training for all Council members and the Planning Commission.
