A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, AUTHORIZING
THE MAYOR TO EXECUTE THE PUGET SOUND ENERGY SCHEDULE 74
UNDERGROUND CONVERSION AGREEMENT AND THE TRANSMISSION MAIN
FACILITY RELOCATION AGREEMENT, IN CONJUNCTION WITH THE TREMONT
STREET WIDENING PROJECT.
WHEREAS, a Schedule 74 is an electric tariff established in 2002 by the Washington
Utilities Transportation Commission (UTC) for the purposes of outlining the framework for the
conversion from overhead to underground of Puget Sound Energy's (PSE's) electric distribution
system (applies only to cities and counties); and
WHEREAS, in September 2005, the inception of the Schedule 74 Project between the
City of Port Orchard (City) and PSE was initiated; and
WHEREAS, in January 2007, pursuant to the city-provided Project Description/Scope of
Work, a Schedule 74 Design Agreement between the City and PSE was executed and PSE
generated a Preliminary Design (Rev. 1), but the Project was placed on hold due to lack of
construction funding; and
WHEREAS, in 2009, the City notified PSE that the right-of-way acquisition and final
design phase for the Project was moving forward with an anticipated 2013 construction phase
Award date; and
WHEREAS, in 2013, after PSE had advanced the Project Design (Rev.5), the City notified
PSE that construction funding was not obtained and that the Project was once again put on
hold; and
WHEREAS, in 2015, the City notified PSE that the Project was 'immediately ready to go'
for the construction phase and that the City was once again seeking construction funding, but
funding was again not obtained; and
WHEREAS, in 2016, the City notified PSE that construction phase funding had finally
been awarded and that the Project was moving toward a 2017 construction Award date; and
WHEREAS, in 2017, PSE has now provided the City with an updated Design and Cost
Estimate and Agreements for both the Schedule 74 Underground Conversion and the
Transmission Main Facility Relocation, now, therefore;
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES
AS FOLLOWS:

THAT: The City Council authorizes the Mayor to Execute the Schedule 74
Underground Conversion Agreement and the Transmission Main Facility
Relocation Agreement, in conjunction with the Tremont Street Widening
Project.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and
attested by the City Clerk in authentication of such passage this 14th day of February, 2017.
