A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON,
INCREASING THE FEES FOR CONFLICT DEFENSE PANEL ATTORNEYS
AND JUDGES PRO TEM
WHEREAS, the City of Port Orchard has occasional need to hire defense panel attorneys
when there would be a conflict of interest resulting from the City's contracted public defense firm
representing an individual; and
WHEREAS, the City of Port Orchard has occasional need to hire a Judge Pro tern to serve
when the City's Judge is unable to perform duties due to mandatory training, mandatory
presiding judge administrative duties, illness, vacation, or other scheduling conflicts; and
WHEREAS, the City of Port Orchard has determined that the current rate of pay of $38
per hour for "conflict" defense panel attorneys is much lower than the rate paid by other local
courts; and
WHEREAS, the City of Port Orchard has determined that the current rate of pay of $50
per hour for serving as Judge pro tem is much lower than the rate paid by other local courts;
and
WHEREAS, the City of Port Orchard wishes to maintain the ability to hire "conflict"
defense panel attorneys and individuals to serve as Judge Pro tem, and can continue to do so by
offering a fair and reasonable compensation for services rendered, and
WHEREAS, the City of Port Orchard has been awarded State of Washington Public
Defense grant funds in the amount of $15,000 for 2016 to improve the quality of public defense
services to meet the Public Defense Standards referenced in RCW 10.101.030, now, therefore;
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES
AS FOLLOWS:
THAT:
1. "Conflict" Defense Panel Attorney Fees: Effective January 1, 2016, the fee paid to
individuals serving as "conflict" defense panel attorneys shall increase from $38 per
hour to $55 per hour, not to exceed a total fee of $550 per appointment. The fee
paid to individuals serving as "conflict" defense panel attorneys for appeal cases
shall be paid $55 per hour, not to exceed a total of $1,200 per appointment.

2. Judge Pro tem Fee: Effective March 1, 2016, the fee paid to individuals serving as
Judge Pro tem shall increase from $50 per hour to $75 per hour with a 1 hour
minimum.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested
by the City Clerk in authentication of such passage this 23rd day of February 2016.
