A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, FIXING THE
DATE OF PUBLIC HEARING ON A PETITION TO VACATE A PORTION OF CITY
RIGHT-OF-WAY COMMONLY KNOWN AS SMITH STREET
LEGAL DESCRIPTION OF STREET VACATION
BEGINNING AT the Southwest corner of Block 8, Replat of Central Addition to
Sidney per plat recorded in Book 1, at Page 79, Records of Kitsap County,
Washington;
Thence South along the East margin of platted Hull Street, a distance of 30.00
feet to the centerline of Platted Smith Street;
Thence East along the centerline of Platted Smith Street to the West margin
of Port Orchard Boulevard;
Thence Northeasterly along the West margin of Port Orchard Boulevard to
the South line of Block 8 of said Replat;
Thence West along the South line of Block 8 of said Replat to the POINT OF
BEGINNING.
WHEREAS, the petitioner, Mr. David C. Preston, has submitted a petition to vacate a
portion of the City right-of-way commonly known as Smith Street; and
WHEREAS, the petition has been signed by the owners of more than two-thirds (2/3) of
the property abutting the area proposed for vacation pursuant to RCW 35.79.010; and
WHEREAS, the property sought to be vacated is approximately 15,000 square feet (60'
wide x 250' length); and
WHEREAS, petitioner has requested that proceedings be had hereon for the vacation of
the above described portion of said right-of-way in the manner prescribed by RCW 35.79; and
WHEREAS, the City Engineer, Community Development Director, and City Attorney have
reviewed the petition and recommend moving the petition forward to the full City Council to
conduct a public hearing; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY
RESOLVES AS FOLLOWS:
THAT: A public hearing upon said street vacation shall be held in the Robert
G. Geiger Council Chambers at City Hall located at 216 Prospect Street, Port
Resolution No. 062-16

Orchard, Washington on Tuesday, October 11, 2016, at 7:00 p.m., at which
hearing all persons interested in said street vacation are invited to appear.
THAT: The City Clerk is directed to post notices of the hearing in three
public places, confirm that on the street to be vacated the posting
requirements have been met, and to mail notices to all owners of any
property abutting the portion of street to be vacated, pursuant to RCW
35.79.020.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested
by the Clerk in authentication of such passage this 13th day of September, 2016.
