A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, AUTHORIZING
THE MAYOR TO EXECUTE A PEDESTRIAN PATHWAY EASEMENT FROM YOUNG
& NAM, INC., THEREBY ACCEPTING THE 12-FT EASEMENT REQUIRED
PURSUANT TO SHORELINE DEVELOPMENT PERMIT #60-94
WHEREAS, on March 1, 1995, the City of Port Orchard and the Department of Ecology
approved with Conditions, Shoreline Conditional Use/Variance Permit #1995-NW30010 and
Shoreline Development Permit #60-94 for the construction of a motel and restaurant; and
WHEREAS, pursuant to Condition No. 4 of Shoreline Development Permit #60-94, a 12-ft
wide easement running parallel along the northern boundary of the property, immediately at
the top of bank, from the east to the west property line, was required; and
WHEREAS, on June 29, 2016, the Owners of the Comfort Inn (Young and Nam, Inc.)
executed a 12-ft Pedestrian Access Easement, in compliance with Condition #4 of Shoreline
Development Permit #60-94; and
WHEREAS, said 12-ft pedestrian pathway easement will be combined with a City
acquired 8-ft Pedestrian Pathway Easement in the near future, as required for the construction
of Segment #3 of the Bay Street Pedestrian Pathway Project in 2017; Now, Therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES
AS FOLLOWS:
THAT: The Port Orchard City Council authorizes the Mayor to execute a Pedestrian Pathway
Easement from Young and Nam, Inc., thereby accepting the 12-ft easement required pursuant
to Shoreline Development Permit #60-94.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested
by the Clerk in authentication of such passage this 9th day of August 2016.
